You need an attorney. I would look for an attorney who is familiar with child abuse and neglect cases. If you can't afford one, ask the court to appoint one for you.

You can file a petition with the juvenile court or the mother can sign a power of attorney. You should discuss the facts with an attorney to help you decide which course of action is best.

Q: Ex works abroad 1-2 weeks a month. Says his new GF will babysit on "his days" when he's away. Can i refuse this?

I am primary parent and we share time 50-50. We have a clause in our parenting plan: no overnight houseguests of the opposite sex unless dating for a year or engaged to be married. He has already broken this with her but is lying about it and I have no definitive way to prove this either.

If his work schedule is new, it might qualify as a material change in circumstance to allow a modification of the parenting plan. I try to include a "first right of refusal" in all of the parenting plans I draft. This allows a parent the right to keep the child if the other parent is... View More

You should consult an attorney. You may have enough to seek a modification, but more facts are needed. I am sorry that you are going through this. Co-parenting with an ex who doesn't want to play nicely can be so difficult.

You should consult an attorney. If you decide that you want the baby to be raised by the father, then the father can still seek child support from you. He will need to petition the court for custody if you are not married.

If you are not happy with your lawyer, you have two choice: 1) keep going like you are going or 2) find a new lawyer. Custody cases are tough. They are based almost solely on facts--lots of facts. Without knowing all of the facts, an attorney can't offer an opinion in a forum like this.... View More

If you didn't go through court and there is no court order, then it is not custody. At most it was a power of attorney. A power of attorney can be revoked at any time. I recommend contacting an attorney to look at the paperwork.
