Q: A cyclist collided with my vehicle. He was severely injured. I was not DUI and did not run. What should I do now?

After the accident, I called 911 and the ambulance came and took the cyclist to the hospital. The police asked me to go to the police station and performed a series of sobriety tests, I also had my blood drawn. The police still has my car now and I want to know what may happen next.

If you were under the influence of drugs or alcohol you may be charged with DUI resulting in serious injury. If you were not under the influence the police will try and determine who was at fault. In either case, contact your insurance company. Good luck. Patrick Steinfeld

The legal process moves very slow. It doesn't sound like the problem is your lawyer. He is waiting for the draft from opposing counsel. Once he receives the draft he may request changes. This all takes time. Hang in there and keep checking in with your lawyer.

This is NOT bad faith. You have $25,000 UIM. The adverse driver has $15,000. So they are underinsured for the difference of $10,000. Settlements are confidential and therefore not part of any public record (i.e. courts file). A lawsuit may or may not get you the information you seek. Focus on your emotional and physical recovery. If a doctor says you need surgery then you need surgery. Your lawyer does not get to dictate your medical treatment.
