Q: I have changed my status from an F-1 to an H1B visa on US soil. Do I have to be out outside the US to renew my visa?

I had an f1 visa on my passport and I do not have an h1b visa stamped on my passport, however, i got a legal status for a h1b last October (2021). I wanted to enter my visa and was hoping that this would allow me to travel internationally, however my visa on my passport is still an F1.

She’s sending texts saying if I don’t pay her thousands of dollars she’s going to the police. She also has a video recording of me talking to her that she illegally recorded while the phone was in her pocket.

You did things incorrectly.

You should have prepared a One Stop concurrent AOS to LPR package instead of filing a standalone I-130.

Immediately seek a legal consultation as you may damage your mother's case even more.

There are better legal strategies available, such as petitioning for foreign national immediate family members if a USC is over the age of 21.

You may legally change your name by filing a petition with local civil court provided you meet the resident and other court imposed requirements for that name change pursuant to the local rules of civil procedure.

Your son may immediately petition. his foreign national spouse to adjust to LPR (Lawful Permanent Residency) right after they married, if he is a USC and she qualifies otherwise. There was no reason to wait three years.

She did finished the probation she was given, they gave her a bunch of paperwork that was not translated to her she just signed she’s been in Mexico for 6+ years. I have that paperwork with me as well.

That is questionable, especially after she served time in jail. It that is a CIMT, she is not eligible.

Do not act without a decent immigration counsel advising you on your next move: you may be detained, and issued a Notice to Appear in Immigration Court for removal.

She may call the police yet, the police will investigate that matter and in order to charge would need to gather enough evidence for the charges to be approved.

You do not indicate your status in the United States and your legal grounds for sponsoring your spouse, however, even generally, you may not sponsor your foreign national immediate family members (parents) until you naturalize.
