You may want to consider speaking directly with an attorney and filing for divorce. Only a judge can address your living situation through a court order and/or hold your spouse accountable for his actions.

Hi, I am the non-custodial parent in the state of Georgia with visitation every other weekend. From a mediation back in 2019 I pay child support monthly. It also states "parties shall each pay one-half of the child extracurricular activities".

You are bound by the terms of the order. Therefore, if the order says that you pay for half of extracurricular activities then that is what it means.

Q: In the state of Georgia, can a text message be used as a legally bound contract?

This "agreement" would be related to payments being made to grandparents for a child's vacation by the child's biological and primary custody mother.

A party is legally bound by a court order with regard to domestic matters. Text messages and emails that are not reflected in a court order parties do not legally have to follow, that is, again, in matters involving child support, child custody & visitation.

You should consult an attorney directly. You have multiple issues that you need to discuss with someone and I don't think anyone can properly address those through this board. Further, if you currently have a divorce proceeding pending, it is important that you obtain an attorney, especially... View More

There is no statute that provides a deadline within which a father has to file an action to legitimize. He can file at any time and must have you properly served, before the case will move forward.

I would advise you to speak with an attorney to determine how to respond to the petition to terminate your guardianship. If you would like for the children to remain with you, then hiring an attorney is your best option to responding to this case.

You can file for an uncontested divorce yourself in the county where you live. All the correct paperwork must be filed because the court will not sign a final order if anything is missing or incorrect.

Q: I have primary custody and non custody parent fled ga with child. Can I file an emergency hearing without other parent?

Mother has been located in another state, children are currently in foster care due to mother being arrested and secondly because mother has allegations of abuse. Other state has proof that all allegations in Ga has been closed but is still seeking jurisdiction over my children

I would consult directly with an attorney because there’s a lot of information missing from your question. If you are the primary custodian, why weren’t the children simply released back to you? Consult a lawyer regarding jurisdiction and how you need to move forward.

Hire an attorney immediately who can file the proper paperwork and get you back into court. You need to get temporary custody until you can get custody on a permanent basis. I would urge you not to represent yourself in this action. Get a lawyer ASAP. Contact them and schedule a consultation.

Q: I believe my ex may have gotten a TPO but I haven’t been served. Can I be arrested for calling her if I didn’t know

I was unaware of the TPO but the sherif showed up at my home while I was at work and apparently had riot shields and guns drawn which seems like a lot to just serve a TPO. They didn’t enter my home or leave any paperwork.
