Q: CA ATTY's :Is an SR22 start date the date of admin suspension received from the DMV or the date of court conviction?

Admin suspension effective March 20 2020. Date of court conviction 6/20/2022. Been carrying an SR22 since March of 2020 so the removal date would be Mar/April 2023 if it began at the DMV admin suspension. (All DMV fines and reinstatement fees have been paid)

CALIFORNIA COURT IMPOSE 3 YEARS OF SUMMARY PROBATION ON MOST MISDEMEANORS.

IT SHOULD END AFTER THAT AND BOTH DMV AND THE COURT WILL SUSPEND THE LICENSE.

YOU WANT YOU LAWYER TO REQUEST THE COURT CONSIDER THE DMV SUSPENSION ALREADY IMPOSED..........WE USUALLY GET THAT.

IT DEPENDS.

BUT YES, THEY COULD CHARGE EVERYONE......HOWEVER, IT PROBABLY WILL NOT STICK FOR EVERYONE.

THE DRIVER IS USUALLY CONSIDERED TO BE AWARE OF ANYTHING ILLEGAL IN THE CAR.

I WOULD THINK TRANSPARENCY WOULD BE A BETTER COURSE OF ACTION.

Q: If a person was told they are going to be facing a federal indictment, and the person has been in custody

approximately 10 months and there still is no indictment. Well, what does this mean?

they can't keep you in custody and not have pending charges filed.

there must be other cases/charges with which the defendant is dealing.

NO, not if you are no longer on probation for anything.

However, more info would be helpful to learn if there was another case with formal or informal probation or a past probation violation where the time was extended.

either you retain a lawyer to talk to the DA or talk to the Defendants's lawyer and let him/her walk you through it.

remember it is the People of the State of California who are the plaintiffs........not you.....................only the DA can drop charges at this stage.

why was case dismissed?

dismissed or not guilty is not the same as innocent.

if your looking for a whistleblower suit you need a civil litigator.

if your looking to collect a small amount of money owed (less than $10k) use small claims.

have you reported to police?

More info is needed, and it should be shared with a real estate, not a criminal attorney.

chances are you will need a lawsuit in small claims court.

if he had not moved out, you would also be looking into an unlawful detainer.............

this is NOT domestic violence in my opinion.

on all criminal cases, the court will appoint a public defender or defense lawyer if you can't afford one.

if the case is over you then need a criminal appellate attorney and most lawyers on this site are not appellate lawyers.

you should call your local police station if there has been a crime.

on a civil standpoint, you can file in small claims and sue for up to $10k

if you had an accident, your insurance co should be defending you.

if you did not have ins, the DMV will suspend your license for a year when they learn of this.

have you called the police to see if they would get involved.....or have they said it was a civil matter?

you can file a Restraining Order and sue him, however, most lawyers would probably want money up front.
