Q: How do I get my police report before my court date

your lawyer should be able to obtain it from the DA.....otherwise, it should be given to you at your first court appearance called an Arraignment.

you can also call the DA or DMV to get a copy.

DMV will send it before the hearing date re suspension.

Q: I've told a law firm I no I don't need there service. They keep asking me to sign a contract and won't stop

After telling them I found another lawyer and if I needed there service I would call them. They message me everyday and it I looked over the contract to sign so they can get started on my case. I told them I'm not signing anything and I don't need there services. They won't stop.

have the lawyer you found contact the first firm.

if you signed up with them already, then you have to sign substitution of attorney papers...........or at least a demand letter by new attorney of all paperwork the 1st atty had.

Incident to an arrest the police will inventory items.

the police stop a person and then submit a report to the DA who then decides what to file.

if you have 2 DUI's they will suspend your license if within short period of time.

why was case dismissed?

dismissed or not guilty is not the same as innocent.

if your looking for a whistleblower suit you need a civil litigator.

if your looking to collect a small amount of money owed (less than $10k) use small claims.

you may want to pose your questions on this site.

if you had an accident, your insurance co should be defending you.

if you did not have ins, the DMV will suspend your license for a year when they learn of this.

have you called the police to see if they would get involved.....or have they said it was a civil matter?

you can file a Restraining Order and sue him, however, most lawyers would probably want money up front.

don't forget you can file in small claims court and get into court...

This is not the type of case a lawyer will take on a contingency...in all likelihood.

You will find it will be too expensive to retain a lawyer on an hourly.

I suggest you prepare a demand letter and when they don't respond, sue in Small Claims for $10k (the maximum)

your question is not clear.

police need to have probable cause (PC) to search and many things are considered PC.

depending on the facts PC may have been the backing in???

i doubt if the PC will be determined to be your 2006 drug charge that was expunged....

Q: Wrong size implants were fraudulently put in and 2nd expert surgeon said v.high chance of complete implant failure.

this is a DMV issue ...not a court issue.

DMV requires the IID before you can get your license back. Thus you would go to DMV and request an ID Card. It looks like a CDL.

if they return/reissued your CDL there would be no way for you to be stopped from driving someones car.

You need to get a copy of the police report at the 1st court appearance, called an Arraignment. Ask the court to appoint a public defender who will assist in your getting the report.

If you are looking to sue the police for damages, then the report will show what the police say the facts...

the best advice any lawyer can give you is to ask the court to appoint a Public Defender at your first appearance.

s/he will have access to a police report and any other evidence.

did your driving cause you to CUT OFF another car, that then got in an accident?

if they can prove you were negligent, then they could present a claim... with enough evidence.

however, I think it would be an uphill battle for them without good independent wits

they can help you collect money by presenting a Uninsured Motorist claim against your auto policy.
