On the ankle it was on. I had it switched to the other ankle and went to the ER. It caused dermatitis and cellulitis in my skin. the first thing i would do is contact the lawyer who represented me on the case.

s/he can go back to court and put the matter on calendar to have the sentence revisited and possibly modified.

Q: What happens if my attorney is suing the wrong entity of 711 for premise liability?

My attorney filed a lawsuit against 7-11 franchise for a stabbing I sustained on 711 premises. Opposing counsel for 711 corporate is saying they are not liable and to go after property owners. What are my options if I dont win. Is my attorney at fault since he has dealt with 7-11 claims. Thanks

your attorney can Amend the Complaint or refile it.........if the attorney did something wrong that prevents you from recovering you may have a Malpractice suit against him/her.

Remember: Insurance does not cover intentional acts as a rule.

It sounds like your issues are more family law.........unless you were arrested and are being prosecuted.

there is often a difference in the evidence presented by a defendant and the DA.

When you say illegal, you are talking criminal. That would require your proving criminal intent. I would want to hear the doctor's version.

you just retain a new local lawyer, and s/he will assist in the transition.

In an accident case, the 2 lawyers will split the fee.

In a criminal case, you would try to get a bill for what the lawyer has done and get the balance turned over to the new lawyer....

i don't think DMV and the Court will allow you to drive until you have done everything ordered by the court and DMV.

when I make a settlement, I often say, "my client will accept the offer, if he receives the money in the next 10 days".

your lawyer should be able to obtain it from the DA.....otherwise, it should be given to you at your first court appearance called an Arraignment.

you can also call the DA or DMV to get a copy.

DMV will send it before the hearing date re suspension.

if you signed up with them already, then you have to sign substitution of attorney papers...........or at least a demand letter by new attorney of all paperwork the 1st atty had.
