Once a person has overstayed his visa and has acquired out-of-status time he is unable to adjust inside the United States unless it is through an immediate relative. To know whether he is eligible for any other immigration benefit requires more information.

No. As an adult sibling you are a priority relative rather than an immediate relative. You must go through consulate processing. The only way you would be able to adjust status in the United States is if you are in the country with inspection and you do not have any overstay or unlawful presence.

Your filing costs for the I-485 are $1225.00 and include an EAD and Travel Document. Attorney fees may vary. I do not quote attorney fees online or to a person without speaking with them either by electronic means or a personal consultation. Each case carries its own set of facts.

You are correct that when a married woman conceives a child the child is presumed to be her husband's child.

You do not need to adopt your biological child. You need to establish paternity.
