The mother legally has sole custody of the children. I did not realize I did not have joint custody, because I've had the kids over 60% of the time every year. The kids are with me during the school year and alternating weekends, while the mother has the kids all school breaks and alternating... View More

It's almost impossible to guess what a judge will do without knowing what ALL the evidence will be at a hearing. From what you've said, looks like you're the de facto primary custodian. You should consult an experienced Family Law Attorney, in your area, for help with this... View More
He signed a denial of paternity as well. But I wasn't sure if I can still do uncontested since it asks if theirs any children which technically there isn't.

There are just too many factors involved to give a meaningful answer. For example, was the child placed there by a court order? Were you required to do anything under that Order? The ULTIMATE answer to your question is "Is it in the child's best interests that you have custody?" Any... View More
Friends wife is on drugs, no job, and no place to live. My friend has a clean record, has been at her job for several years, and owns a home. She is also Choctaw Indian that provides childcare and insurance if she is able to gain custody and adopt the children.

WOW, sorry I didn't see this earlier. This one is a bit complicated, and it doesn't look like there is any good answer for your friend. Since your friend's wife is still married to another man, their marriage to each other is void. These children have a father and a mother. I... View More

Since you're a resident out of the country, it gets complicated. Ordinarily a change of name needs to be filed in the County in which the person resides. See 12 OS Sec 1631 http://www.oscn.net/applications/oscn/deliverdocument.asp?id=94759&hits= , which provides as follows:

She was on hospice when he made the decision to marry her.
answered on Jan 22, 2018
Yes, that is possible. A spouse is entitled to 1 vehicle of their deceased husband or wife, IF they want it, unless the title is held jointly with some other person. Sorry about your mom, hope she gets better, and that her new husband, IF they get married makes her life a bit better.

I hope by now you have found a GOOD, safe, and loving place to live while you prepare for the birth of your child. If you still need some kind of help, ask your question again.
I need help with the lawsuit. This is a definite case.

There are too many factors to consider to give a good answer. Like what are the charges, how long before the birth were they filed, are they still pending, how old is the baby. I can tell you however that you are entitled to a court hearing before this happens for any other reason than... View More

I can't tell you "how likely" this is. It's up to a judge to make the decision, and there are many, many factors to be considered in a case like this. Your Ex will have to file a "Motion to Modify Custody" in order to do this. You will be given notice if this happens.... View More
biological father wants to try and come in after all these years can he
answered on Jan 22, 2018
Your question isn't totally clear, but as I understand it, this is your situation: You have been married to a man who has taken care of your son for 5 years, and is on his birth certificate, but he was not the bio dad. Now that your husband is out of the picture, Bio dad it threatening to try... View More
My husband is the legal father on the child's birth certificate signed by a Florida judge. I'm trying to figure out if I can take my son being that no custody was sought out by the bio through Florida or Nebraska. Nebraska no longer holds jurisdiction of the child.

Your legal problems with this son are just too complicated to give you a good answer without knowing more about the facts. But this much I'm pretty sure about. If the custody was placed with the "Bio Dad" was there a paternity DNA test establishing Bio was in fact dad? If so, the... View More

answered on Jan 22, 2018
Gosh, sorry you are so far away from McIntosh County. First, I would ask the Judge to appoint an attorney for you. Before doing this however, you should phone some attorneys who practice in that county, and see if you can hire them with a down payment you can afford, and a payment plan for the... View More
