it is not up to your wife to decide if she wants to drop the charges..........the crime is against the people of the state of california.

I pressed charges on Sunday morning for domestic violence and he’s been in jail since then. My question is when will he get out. The abuse was minor I only have bruises on my leg and little scratches on my hand. He’s never been to jail he had a clean record prior to this.

DV does not have to draw blood or be black and blue..........a shove is DV............though maybe it shouldn't be
for a minor it will be a violation of the welfare and institution code in that on X day the minor did ........................

did you get notice of a TRO (restraining order)?

R u saying there was a TRO without a criminal filing?
i would not think old DV would be filed upon ......if so you would argue Serna arguments that there was a lack of due process in that you didn't receive a speedy trial and can not remember things 2-3 yrs ago.

You are not legally separated. You can file in California since you have lived here at least six months and file in the county you have lived in for the last three months.

the lawyer could have meant he could not or did not get a dismissal/not guilty.
however it would not be grounds for dismissal but maybe a new trial for incompetency of counsel...........................if that was the case.

I assume you mean CPS?......any unlawful touching is a battery...........and could be an issue.
