Any recovery for wrongful death would be paid to the estate and would be divided up either according to the will or the laws of intestacy, not to you as the person who wanted to bring the action. The action would need to be brought by the executor or administrator.

Q: What can be done when procedures that weren’t ordered are done.

We ordered 2 tests done and blood drawn for those two tests. The facility drew blood enough for 6 tests and is currently processing those test that weren’t ordered through them. Do we have any sort of case.

Q: Can my doctor refuse to treat my dad at home just because it is too far from him?

You can't make a doctor make home visits. Contact visiting nurse and see if they can act as the doctor's eyes. Also if the problem is transportation some dommunity groups may provide that type fo surgery.

If he has osteomyelitis, perhaps. If not, unlikely, but get a consult from a member of the Ct. Trial Lawyers Assn who handles medical carelessness cases.

Q: Received a tubal ligation with out informed concent is this malpractice? I was brought a c section consent only

My mom inquired with the doctor with out my knowledge I'm 27 and want more kids. No consent form was ever read to me nor brought to me I thought I was only giving the consent for my c section. I never mentioned to anyone I wanted it and didn't go to the proper counciling

It might possibly be a medical malpractice on the theory of lack of informed consult. You should consult with a medical malpractice attorney who can gather the records and have an expert review them. Of particular importance will be the consent form - the actual language on the document you signed.
