spent with each parent. Received a court order today to attend a child support hearing. Can the state of Illinois legally force a child support payment even if both parents do not want any child support from each other?

Usually no because they are collecting for her.
She may be saying no to you but yes to them.

If somebody already won a similar case, try to track the lawyer who won it.

If it was court ordered, then why didn't you attack your parentage then.
You haven't said if you signed a VAP (Voluntary Acknowledgment of Parentage).
I am self employed and at the time the economy was good then it crashed and so did my income. I never went back to adjust it because my ex was understanding. Now whenever we argue i am threatened with court. She makes double what I do and only has my daughter maybe 40 days more than me each year.

Need more info.
How did child support get implemented.
Is there a court order.
Should I stop giving her any money until court date?
answered on Sep 28, 2017
No, but if he doesn't pay, he could be taken away from you for contempt.
If the custodial parent (mother) is asking to modify support (increase) based upon the fact that the noncustodial parent (father) has had a substantial increase in income, does this case fall under the new law or would the courts modify this under the old law that the original order was set in?... He has only paid the ordered amount 2 months out of the last 12

You can do contempt for failure to pay child support.
You don't have to rely on state. You can do your own petition and request financial affidavit.
We have 0 contact with him last time any contact was made was when the 21 year old was 5. He probably lives in Wisconsin. What can i still do if i can do anything?

Is there a court order.
Does he owe back child support.
If so, you can collect the back child support.
Usual rule is you only get child support from the date you file and/or serve the petition.

I was 16 at the time. What can I pursue now both custodial wise and to follow the sexual assault. I don't want him having any rights to her has he's only seen her once and she's almost 17 months old and he saw her when she was less than a month old and he is not on the birth certificate.

Is he on birth certificate.
As to sex assault, see if police and state's attorney are willing to prosecute.
I filed against my ex and my ex filed against his ex. There has never been anything thru the court and he is 8 years old. I believe he filed so that I would get a lesser amount. All kids live with the mothers so he would be paying us both.

Each case is processed on its own.
There is a formula used to calculate child support.
The numbers are whatever they are.
My ex previously had custody of both kids but my daughter recently chose to come and live with me. We are going to court to arrange everything officially and stop child support for my daughter. My ex seems to think that I will still be required to pay her for our son, but she won't be required... View More

Under the new child support law there is a formula to figure out the child support amount.
It is based on time spent with child and income.
My ex and I have another daughters whose 16 and I still need to pay support for her. But I have since been remarried. Will the support amount just be based on my net income or will my wife's income now be a factor??

Unless it is written that way, support stays the same until it is changed.
