Yes. That would be contradicting your case. Wait til the court orders it.

Q: If you have a child out of wedlock, the father did not establish paternity, nor sign the birth certificate.

Who has custody of the child? And can the father who’s not on said birth certificate or has not established paternity can he legally take the child from mother without court intervention.

The putative father has no rights to the child until they are established by the court by paternity or default. He cannot take the child legally prior to this unless by agreement.

Q: Can a child go to the school district of the non-custodial parent?

My child has been going to that school district since 5th grade and is now a junior in high school. I won't be living in that school area anymore (moving one county over), but the non-custodial parent does. I can get my child to and from that school, even after moving.

Not likely they will take this child if she’s clean snd you have a spotless history. If they attempt to take the child, hire a lawyer and file suit immediately.

Q: How long can a child custody case stay open in KY with no pursuit from either parent in over 19 months?

Once paternity was established in April of 2020 and automatic child support issued by the court neither parent has pursued having the custody issued finalized that was initially filed in December of 2019. Will that case still be open or will it have been dismissed/closed?

The case can stay open as long as the court permits it. Each case is determined on the merits of its own facts.

Not much, really. I suppose you could file an action but generally that sort of thing is largely in the discretion of the mother. Not saying that’s right but merely saying that’s how it usually is.
