Right before the background check. You also might want to think about expunging that misdemeanor from your record so this is not an issue in the future.
Also, which State if I remote work permanently in a different state than my employer. I pay state taxes to Kentucky but support Federal Agency in Virginia.

You may have a claim for the 4-5 hours you worked but that is all. The Labor Board might be interested in the fact they showed you as terminated in the system. That smacks of fraudulent behavior.
My supervisor advised me that I would be fired if I didn't come into work on my scheduled off day. We are all "on call" but we are not paid to be on call.

I work for a nonprofit that is under the abilityone program. My doctor stated in a letter to my employer that I can only work 8 hours per day. Several other employees have similar restrictions. One only works 4 hours per day.
