Q: My sister has an old temp custody paper for my great niece. How can my niece get her child back?

My niece has her own place and my sister has her child but the temp custody papers need to be renewed but she still refuses to give her back.

It it is a Judgment, your neice needs to hire a custody lawyer to file for custody.

If it is a Custody by Mandate, it is only good for one year.

If this is a Juvenile Court matter, then the State has custody and decides who the foster parent will be. If this is a Family Court matter, then her attorney can argue about the fitness of the person getting custody.

Joint custody means you both have to mKe any non emergency decisions for them. Joint custody can range from shared 50/50 to alternate weekends. He may still have to pay child support even with shared custody if he makes more than you. Hire a custody lawyer.

No one has automatic custody. Both/either parent needs to file for custody with a lawyer

Court granted me full custody about 2 years ago and the other parent has not seen or tried to see his child. He does not want him and has agreed to sign rights over if i pay for it. I do not have the money so was wondering about filing abandonment on other parent to terminate his rights

He can't "sign over his rights" unless there is a new parent to step into his place. In other words, if you get married, your husband can adopt if the bio Dad has paid no support and failed to visit.
