No, you're not personally responsible for any debt incurred by her prior to the marriage. However, if you don't have a pre-marital agreement (a prenup) then your income is community property until the community is terminated. Q: LA residents recently elope to MS. If one wishes to file for annulment, in which state would they be permitted to?

I would recommend checking with an attorney licensed to practice in MS to see if their law permits an annulment under the circumstances. Technically an annulment in LA is only permitted in cases where the marriage was not legal in the first place.

Q: I sent the papers certified to be tracked. He did not have to sign for the papers. Will that be accepted by judge?

Certified mail without signature is not good service.

Enough for what?

You need to hire a family lawyer because your question is incomplete and it sounds like you are trying to effectuate service of something or other without knowing how.

Q: My husband and I separated we have 2 children how can i keep him from taking my kids before we can file for divorce

I allowed him to meet me to see the kids and he grabbed one of the kids and left. He wants nothing to do with the youngest child. If i get him back how can i keep this from happening again

Q: In Orleans or Jefferson Parish can you file for divorce without a custody agreement if we have a minor?

Me and my spouse are in Orleans Parish. We have separated although we remain friends and wish to co-parent without the courts involvement, but we would like to be divorced. Is there a way for us to file for divorce which does not involve child custody?

Yes, you can file for divorce and not ask the court to address the issue of custody.

If you need a free divorce, you'd have to qualify through your local Legal Aid office. Some lawyers will charge a reduced fee if the divorce is uncontested, especially if children aren't involved.

You need a divorce attorney to file for both custody and divorce. Louisiana only has ex parte custody in emergency situations (substance abuse, neglect, physical abuse, etc) because parents have equal rights.

Q: Wife & I have been seperated for 10 yrs and file uncontested with all 3 waivers signed, how quick can it go through LA?

Just from moment I file till end. How quick a turnaround? She will sign anything for the whole thing is mutual and we both moved on 10 years ago. She lives in TX and I live in LA.

Theoretically, if she signs a waiver of service and both of you sign affidavits, the divorce can be finalized the same day it is filed.

You can date. However, I would not suggest having any "stayovers" until the divorce is final. Some judges can be unpredictable on issues such as fault and adultery.

Q: I married the same person twice, do my 2 minor children born of the first marriage, need to be listed on the 2nd divorce

The minor's are 14 and 15 Years old. they were born in 2003 and 2004. our 2nd marriage was in 2010. custody was settled in 2006 when the 1st divorce was finalized. Does that still stand , or will they have to be included in the 2nd divorce also?
