Yes. Look up the "Boulevard Rule" which applies in Maryland. Also read over MD Code, Transportation, § 21-705:

Speed cameras result in a ticket for $45 once you hit 12 mph over the posted speed. Doesn’t matter how much over. No points. Just pay the money. Insurance companies can’t use it as a basis to raise rates.

If a cop clocks your speed and pulls you over, however, it works like this: 0-9...

Q: Can I dispute the ticket for a School Bus Monitoring Violation?

I was right in front of the bus on the other side of the road when the stop sign of the school bus starts to flash. There were cars behind me and if I make a sudden stop the car behind me would hit me. The video shows the car behind me had not stop too. It was 7:23 am on a two way road on a morning... View More

You can request a trial and go to court. If it was a camera ticket, the judge can watch the video and you can testify. The judge will decide whether you had time to stop.

If a police officer gave you a ticket, you should definitely request a trial and go to court since this ticket carries...

Next time they run the tag in Maryland, with an unpaid ticket, it gets the boot and a tow. Then you pay the tow, storage, unpaid fines that have doubled or tripled on the late penalties, in order to get you car out of hock. And no amount of crying, yelling, belly-aching or screaming at the... View More

Q: Is it smart for a G4 visa holder to contest a parking ticket (wrongly) issued after 52min in a 1hr parking zone?

Google maps timeline shows me departing 57min after arrival. Obviously it was a mistake by the officer. I wonder what's worse for future visa applications - the parking fine, or whatever records result from contesting and going to court. (In Montgomery County MD contested parking tickets go to... Municipal parking infractions do not impact visa or immigration determinations, unless perhaps if you do not pay the fine; however, anyone can challenge a parking ticket by requesting a trial. Paying it, however, will not impact your status or approval of any future application.

You should get a certified, complete copy of your driving record. This will prove that your license was valid on the date of the incident.

Contact an attorney right away. This offense carries possible jail time and points. If you have a good driving record, jail is unlikely and an attorney should be able to keep the points off your record. You should also get your car insured before court which will make a big difference.

It could be an error. You should go to the Clerk's office and have them pull the file. The judge makes a handwritten decision and you can see it.

Of course, I am assuming that you are saying that you went to court for the improper use of equipment charge in Maryland and it was...

It is impossible for any of us to know the reason the police officer issued the citation. You can request a trial within 30 days of the ticket and go to court. If the police officer does not appear, you will be acquitted. If the police officer appears, you can have a trial.

Do not request a...

No, you cannot sue the police for failure to write a ticket. They have absolute discretion on whether to issue a citation. Regardless, issuing a citation does not determine fault. You can sue the other driver and your own insurance company if he is uninsured and if you win, your rates will not go... View More

Q: Is there a right to a speedy trial for a traffic violation (running a red light)? It has been 2 years and no court date

I was told a traffic camera shows I did not stop at a red light. I have requested a court date however it has been over 2 years and a court date has not been set. Can I request the violation be dismissed due to the length of time for a court date? This is in Maryland, Prince Georges County

You can make a speedy trial argument, but you are supposed to demand the speedy trial for the clock to start ticking on your speedy trial rights. Having said that, there is no harm in making the argument. Any delays brought on by Covid will be excused.

It is unlikely you would be picked up on a bench warrant by going into a bank, but you never know. There are no guarantees.

Your best bet is to consult with an attorney to see if the warrant can be recalled. In some cases, an attorney can file a motion to quash a warrant.

If there are no witnesses to the accident, plead not guilty and the judge should find you not guilty. Even if the police officer appears, that is not enough if the officer did not see the accident and there is no other evidence.

Payment of the fine is tantamount to... View More
