My boyfriend was in a car chase with local authorities on his harly Davidson. And I was wondering if the land owner had to tell them to tow it because it ended on private property and a foot chase but it was on one of our friends property

It isn't possible to give you an exact answer because it depends on the circumstances and the charged offence whether the police can impound the HD. If there was a car chase and the HD drove onto private property, that does not put it into a safe haven and the police may be able to impound... View More

Yes, an experienced traffic law attorney may be able to withdraw her guilty plea and get the ticket amended. However, the outcome depends on 1) which court her case was prosecuted in, 2) how fast was she driving, and 3) how much time has passed since she pleaded guilty and paid the fine.

The police officer is not required to appear for a regular court date for a speeding ticket. If Defendant pleads not guilty and requests a trial, the prosecutor will have the police officer come to court to testify. If the officer doesn't show up for the first court appearance, the judge will... View More
My son got a ticket mailed to him saying he ran a red light back in December and got the ticket in March. How well do these tickets hold up in court or is it worth fighting
answered on Mar 15, 2023
It is legal in Missouri for a court to mail a ticket to a defendant.
A red light violation is a moving violation, so your son can hire an attorney to get it amended to a non-moving, no-point infraction so it won't affect his driving record or car insurance rates.
Of limitations? The first was for a windshield and window tint and the second was for having a tinted plastic cover on his license plate.

Yes, this was filed within the 1-year statute of limitations. The Prosecutor has 1 year from the date when the ticket was issued by the police officer to file the charges.
Pulled over on the 11th for failure to register. Was issued a citation. I looked on Casenet and the officer had issued a 2nd citation which I was not even aware of.

Yes, the police officer issued the ticket, but then it went to the Prosecutor, who can add an additional charge if they want.

Yes, you can hire an attorney to get your Driving While Suspended ticket amended to a non-moving, no-point infraction. You will have to get your license reinstated and provide your attorney with proof of reinstatement. You will have to pay all fines and court costs before the Prosecutor will amend... View More
I got the ticket in Missouri but while in his vehicle when he gave me the ticket on camera he never asked me to sign it on any of the signature spots is the ticket valid he didn't sign the printed out ticket anywhere either
answered on Oct 1, 2022
Yes, the ticket is valid. It makes no difference if the police officer didn't sign the ticket or if you didn't sign the ticket. After the police officer issues a ticket to a driver, the prosecutor has to approve the ticket, and then it goes to the court clerk to be filed on Casenet.... View More

It is common in some courts (especially St. Louis County Circuit Court), for it to take several months for a traffic ticket to get filed and a court date to be assigned. You can hire an attorney to get your tickets amended to non-moving, no-point infractions. You won't have to appear in court.... View More
I no longer live in missouri(moved away in 2020) and just received something in the mail about a warrant. I’m flying internationally in a week and am worried I won’t be able to go/get back. You can hire an attorney to lift the warrant and get your stop sign violation amended to a non-moving, no-point infraction so you won't have any points on your driving record (and your insurance company won't have a reason to raise your rates). You won't have to turn yourself in to... View More
Now, a year later, CaseNet continues to say 'case with PA'. Is this beyond the statute of limitations? When I called the court they said if there is no new date in a year I can forget about the ticket. True?
answered on Jan 25, 2022
Not necessarily. The Prosecutor has 1 year from the date of the incident to file the charge. It is possible that the Prosecutor filed the charge within the 1-year statute of limitations, but the court clerk just hasn't set the case on a docket and notified you of the court date yet. If that... View More

You can show up at court, ask for a trial, and defend the case. A more practical option, if you wish to avoid points against your licenses, is to hire an attorney to contact the prosecutor and seek a "recommendation." That means your attorney would be seeking to have you plea to a... View More

i’m 17, 18 on december 29th. according to the officer, i was going 102 in a 70 zone and was issued a court date for november. this is my first offense. i also use the life360 app which states my top speed was 94mph. what should i do/expect?
answered on Aug 27, 2021
Whether you were going 102, 94 or 71, it is still speeding in a 70 zone. Additionally, you do not indicate what you were cited for----was it for speeding or was it for reckless operation, which is a more serious charge. What you should do at a minimum is consult with a traffic ticket lawyer or a... View More
I'm seeking some advice for a friend not having proof of insurance 11 years ago when he was only 20, and, not appearing in court back in 2010. Now, there's an active warrant out for his arrest---I don't know what a judge would do in this case. I'm just wondering if he needs a... View More

No. Minor errors on the ticket are not sufficient to justify a dismissal. The police officer or prosecutor can correct any errors at any time.

You could receive jail time and/or a fine. In this situation, you may want to hire a lawyer to at least negotiate no jail time.
Ticket 1: Not stopping for an Emergency vehicle. They spelled my first name wrong, and wrote the time for court date at 9pm when our local court closes at 4pm. He also scratched out the first court date he put and fixed it to the correct day.

You can hire an attorney to represent you for the tickets if you want to try and get them amended (reduced) to non-moving, no-point violations. Or you can plead not guilty and take it to trial.

You will need to keep checking Missouri casenet online to see if the ticket has been filed.
