I mentioned this ticket to my lawyer later on I came to find out he marked yes to question 24 and 25 on part 12 of the application. Which imply being charged and convicted for a criminal offense. If your attorney is not going to the hearing or interview, then you may need another attorney to attend. You’ll need proof that you did not have a traffic offense where there was a fine for more than $500. Let the adjudicator decide whether the answer is yes or no. You were ‘cited’ for a... View More

Most states require the person to whom the placard was issued to be with the vehicle while the placard is in use. I recommend you contact several attorneys in your area that practice this type of law, as soon as possible. Thank you for using Justia ask a lawyer.

In North Carolina, a conviction for a moving violation leads to the addition of points on your driving record. These points remain on your record for three years. If you accumulate more than twelve points within a three-year period, your license will be suspended for sixty days. Additionally, if... View More

Depending on the nature of the ticket, it could be a very simple fix or might involve slightly more money. Hire a local traffic attorney to assist you. You will generally get a better deal than negotiating yourself.

Q: Does NC Highway Patrol need suspicion of crime or violation to stop or detain me? Do I have to ID to them/them to me?

I had been stopped by NC Highway Patrol at a checkpoint and asked for my identification. I asked if I had done anything wrong and would prefer not to ID if I didn’t commit a crime, that it was my understanding NC isn’t a Stop and ID State and felt being forced to do so would violate my 4th... Police in many jurisdictions establish check points where they check all vehicles that pass through, mostly looking for DUI, but also for registration/license violations. These are advertised in advance in the newspapers or on the city website. At these checkpoints the law allows the officers to... View More

NA means "not available." This means the officer did not get the plate of the car you cut off.

Q: Should I use the online request for speeding reduction, or hire a lawyer? 48 in a 35 and no prior citations.

You can likely get this downgraded to a charge of improper equipment, which will have minimal effects on you. However, it is at the local DA's description to do so.

An attorney might be able to get an early disposition, but it all depends in part on the county.

You might consider one or more of the following:

1. Check out that county's website.

2. Contact the clerk of court in that county.

3. Consult with an attorney who...

You should contact the clerk directly to confirm that the date provided on the letter is the correct court date. You should also search for your court date at https://www.nccourts.gov/court-dates to confirm your court date.

Send them a copy of your lease, you are not bound by a term that is not contained in your lease. Politely ask them to remove the jack and waive the fine. If they refuse then threaten legal action.

While I don't know what Wiliminton's DA's policy is, it is highly likely that if you hire a local attorney they can plea the ticket down to a level that will not affect your insurance. Generally speaking this costs somewhere between 100-150 and then you have fines and court costs on top of that.

Q: If a traffic ticket has a charge that is false, can the ticket be dismissed?

A ticket was issued for a failure to stop at a 4-way stop sign. If you stop at the sign you cannot see clearly, so I stopped before the intersection, but not directly at the stop sign. Also the ticket says that there was a flashing red light, but there is not.

The particular charge may be dismissed but not necessarily the entire ticket. I suggest that you contact a traffic ticket attorney in your area and ask how the local jurisdiction approach these type cases----hire4 an attorney to represent you if necessary. Good luck.
