You would likely be charged with failure to control your vehicle (infraction) and leaving the scene of a property damage collision (misdemeanor). You will likely face a fine and a serious increase in your cost of insurance.

The judge is correct the time to argue facts are trial. I understand this is not the answer you were hoping to hear, in criminal cases there is not a Motion for Summary Judgment where you are permitted to get a ruling of guilty or not guilty based on undisputed facts prior to trial. You can... View More

No! You still have constitutional rights that protect you and your families. When it comes to being pulled over, the police must have a valid reason to pull you over. They cannot use the stay at home order as justification to pull anyone over and question them.

On the incredibly off chance...

In Arizona, we do not have a law that allows for expungements. However, we do have a law that allows for "Set Asides". This essentially is the AZ equivalent of an expungement or sealing records.

In your situation, it seems as if these offenses occurred 15 years ago and you were...

Q: What are the risk I'm heading into after getting T-boned?

This happened in Arizona.

I rented a "sports" car for my vacation car for a week around 7AM. By 9AM I was on an intersection wanting to make a left turn. I had the green arrow in the traffic light so as I was about to turn, about 40-50 yards out a car hits the peddle and comes... View More

Sometimes facial errors are enough to have a ticket thrown out; the clerks may not be about to enter the ticket information into the court system without a date. BUT, the cop can always fill it in on his copy and file it that way. The cop's copy is the ticket, all you have is a carbon copy.

The answer is fairly simple however the process can be complicated. Essentially, you have to contact the MVD and have them provide you a copy of your driving record. You can typically do this online or in person. Then, on the report you will be able to see which court, if any, have a hold on your... View More

They eliminated suspended license as justification for impounding a vehicle but a REVOKED license will still get the vehicle impounded. Since no license is equivalent to revoked, law enforcement will likely impound the vehicle. The registered owner can petition for an early release of the vehicle... View More
