Q: Can I plead 5th

If I lied when calling cops about dv about some of the other questions they asked (has he ever done this or that) and said yes and now i got a subpoena to be at court can I plead the 5th? I mean I read they can charge you if you lied.

lying to the police is not a good thing.

you should discuss your plight with a criminal lawyer, at a consultation, asap.

many DV victims later say they lied, so the odds are that the police and DA will not believe you.

Q: Hi, I how do I go about filling paper work to remove a protective order that was for me? I’ve never been in danger.

For some reason, the court has the protective order in place until 2023. The case has been dismissed for months now. I called the court but they directed me to the distric attorney office and they give me the run around and aren’t sure why it’s still in place also. I need help please.

Q: Is it a violation of DVRO to have someone else ask me a question for them?

I have a dvro that protects me and my children from their father. It states no contact directly or indirectly. He had his mother text me to ask if he could send the kids a video of him. And that he doesn’t want to violate the order but would like to send the video if I will allow it.

courts really look at the victim as the State of California.........what you want is often not important to the DA/Court.

10-year Ban under California law from date of DV conviction. There is however a Federal lifetime ban on firearms.
