Q: Is driving without a valid drivers license in Florida considered a Misdemeanor?

My wife a long time ago was living in Miami Florida and she did not know at the time about getting a drivers license there. So she had her German license when she was pulled over. So what is driving without a valid license considered? Is it considered a Misdemeanor?

The citation was issued in 1984, How do I get this thing handled?

Also the ticket was issued to someone with a very close but, different last name than mine. Does this matter to anyone but me?

You should have received notice that the license was being suspended. Talk to an attorney in North Carolina about looking into it.

Last year I only had one as well.I was not driving recklessly I just didn't notice I was speeding because the road was empty.

I suspect that technically the officer who ticketed you was correct. But if you can prove what the department told you, it may be possible to get the ticket dismissed. Can you get something in writing from whoever you talked to?

You and your daughter need to attend the hearing, you as the defendant and your daughter as your witness. So you ignoring the signs that said the speed limit was 45 mph, you were traveling at 55 mph. Go to court and see if they will agree to a ticket for 55 in a 45.

Failure to appear is for tickets I did not know I had and I live in a different county and have no knowledge of the citations at all.

It's always best to have an attorney assist you. Depending on the case, you may be able to get the warrant quashed without surrendering. Your lawyer can assist you with digging up the out-of-county citations and help take care of them for you.

If your vehicle was registered at the time, ask for a court date. If the officer doesn't show, the ticket will be dismissed. If he shows, you can argue that you had the registration available and explain what you stated above to the magistrate. Bring the vehicle registration with you to the hearing.

I hope you mean "traffic tickets". If you haven't paid them, yes, in theory you might be arrested, but the more likely outcome is that you would be denied a Florida driver license. As far as a Florida ID is concerned, I suppose you can get one of those.

Did you have an attorney? Did you plea "no contest"? Typically, you have 30 days to appeal. If you are within 30 days of your sentencing, you should consult with an appellate attorney. Good luck!
