He’s trying to officially make it yours and screw you. If it’s not in your name, don’t put it there. You’ll probably have to sue him to get your money back.

Q: Im on diversion program for a class D felony my diversion program review date is soon. What can get me sanction-revoked

I haven't began work yet and one fee isnt caught up monthly. But besides that i completed rehab and clean drug screens on probation and no new offenses.

As long as you have no new offenses and are compliant in all other respects, you should be fine but I would make some regular payment, even if minimal, towards the fee.

No. You can record a conversation without someone knowing as long as you are a party to it but you cannot record surreptitiously without other parties consent.

Q: is there any instance in which the term for a diversion program for class d felony could be shortened?

Charge is theft by unlawful taking. Located in KY. Term is 5 years. If the diversion would prevent meaningful employment in my profession, is there any chance at all an appeal could be made to shorten the term if after a certain amount of time I have performed exceptionally well within the program?

It is possible, but only with the assent of the prosecution and approval of the court.

All depends. Don’t convict yourself before you start. The court will appoint you a public defender if you cannot afford counsel.

Q: I was charged with a.class C felony trafficking meth over 2 grams but no meth nor money wqs found on me

Nor was there any kind of controlled buy the meth was found in anorther room in toilet which there was some one in trying to hide should i fight this

Q: Should you have to pay to bond out and be put on ankle monitor?

My husband got his bond reduced and they also said after bonding out he will have to go on ankle monitor. How is that possible to have to do both considering they are two different types of release.

The court can make it add any conditions of bond or release as it seems necessary. Bond money and home momitoring are merely two of the conditions the court can impose.

If it is not described in the warrant, it cannot be searched using that warrant.

Q: How important is the coordinates to be correct on search warrant? Does it matter if address is not completely accurate?

The coordinates is not accurate for the actual address nor the address they have written on search warrant. The address is supposed to be 1234. “””” rd but it’s 1267”””rd. And the coordinates that is written on search warrant matches neither. Is that not a issue at all.

That is definitely an issue. You may have a valid suppression issue to raise on the defective search warrant.

Q: If someone was caught on camera committing a crime and residence was in a different county who signs SW for residence?

What judge would sign search warrant for your residence and who would sign arrest warrant,the county the crime was committed or county your residence is located? What county would the returns be filed in?

Q: How important is the time stamp on search warrant it’s been executed? Can a judge notarize the same warrant she signs?

No time stamped on time search warrant was served or signed or notorized,date but no time. Does it have to be filed in clerks office after it’s notorized and before search warrant is signed or can it all be after it’s executed?

Should have s time issued by Judge on warrant. Does not have to be filed in clerks office but usually are returned to the clerks ombudsman’s office after service.

Yes. The minor has no status to give and receive property if his parents oppose the gift.

If the judge told him to take the dv class, he’d better take the dv class. The county clerk does not handle the matters as you describe. Call the public defenders office and ask where to take the dv class so he can have it finished by 9/27. There does not appear to be any conflict of interest... View More
