The car accident took place at February 28, 2020
answered on May 26, 2020
Likely no. Our no-fault system makes your insurance company responsible for your medical bills. About the only way to get outside of the no-fault system and sue the other driver is if you suffered a serious impairment to a bodily function (e.g. paralysis, amputation, etc.). Back pain, usually,... View More
I don’t think I should be forced because I’m not sick I don’t have to be tested when I go to work and to me it’s a forcible action to be able to track you and follow your whereabouts in quarantine you you don’t think that’s a overreach of government

Likely yes. The medical professional could refuse services if you don't, unless it's an emergency situation. I'm not sure what benefit you'd receive by refusing. The procedure you receive could be compromised because the doctor doesn't have a complete picture of what is going on.
I had to have surgery to wire and pin it back together, the area I fell was a dangerous area unknown to me but the owner knew because I was later told he was asked to fix it several times but refused I was also told he normally had warning cones set in this are but not the day I was there, a... It's difficult to tell, based on these facts alone. It would be helpful to know why the cones were removed, the extent of the defects involved, among other factors. You could contact a Michigan injury attorney to discuss the matter in greater detail, and that would probably enable a more... View More
I stayed at a hotel in Southfield Michigan and noticed the sliding glass door for the shower was coming off the rail on the back top rollers. My roommate notified the front desk about the issue and the man told him he will call a work request in and to just be careful with it. I went to take a... View More

Yikes! I would think so. At the very least, I would be in contact with hotel management - in the case of a chain hotel, I'm not talking about the local people; I'm talking about the actual parent company.

I was getting out of my car to go over to the service area on March 12 2019 at a carwash, I was going to get change, I slipped and fell in a shaded area on what is called black ice, as a customer came to help he also fell.
answered on Mar 12, 2020
It could be, but if you consulted with a Michigan attorney who could examine more details about how your injury occurred, what precautionary measures were taken to melt or remove ice, etc., you could get a more complete picture of the respective liabilities here. Good luck

On January 22nd, 2019, Sara, my daughter, was pushed by another student and fell on her head on a concrete floor covered in carpet.

You raise a number of good issues; however, I believe it is less complicated. The school must have premises liability to cover any injuries to persons on the premises that are there legally. The facts that you allege regarding negligence help your argument and serve to defeat a defense that your... View More
If I got a strawberry banana smoothy from McDonalds about 6 years ago and I found a needle as a sucked through the straw. I bit down thinking it was ice and it poked my mouth. I have the needle still. I was wondering if I still have a strong case.
answered on Mar 4, 2020
No. Why bring this up now 6 years after the fact? I would imagine McDonald's lawyers would attack that right off the bat.
This is a very strange situation; I have been seeing a spine doctor for 8 years. My doctor wrote a couple scripts for medical equipment and letters to support their need. My insurance company sent letter with more questions to the doctor. I then contacted the medical records dept. of my doctors... View More

It's difficult to offer an answer without knowing what the letter contained and what the grounds for the denial was (medical necessity?). You could consult with a Michigan attorney to learn if they feel it would be cost-effective to pursue. Good luck

It allows an individual to recover $500 to $1500 per call or text made in violation of the statute. The statute is a little complicated and I recommend... View More

You should contact a Michigan attorney if this is something on which you are contemplating a claim. Your post remains open for a week and it looks like two-plus years have already elapsed. You should act without further delay to discuss state statutes of limitations for the applicable legal... View More

There wasn't a question here. If you're wondering whether the claim adjuster is liable for the amputation, the answer would generally be "no" in most any jurisdiction. A claim adjuster does not owe anyone a duty of care on the level of a medical practitioner. A claim adjuster... View More

I believe I may have answered this question previously because the facility name seems familiar. My response was that although you suffered a painful and aggravating ordeal post-op, you mention that the surgery went well. Med mal cases are generally based on a breach of duty. As a practical matter,... View More

According to your description, your surgery went well. The other issues you describe here (while you explain there is more) depict considerable pain and aggravation you endured in post-op. However, it's important to keep in mind that medical malpractice lawsuits are very expensive to litigate... View More

You could ask for one if there is something very acrimonious in the chemistry in your working relationship. But for the most part, the role of a claim rep is adversarial to the claimant. The claim rep is not there to be a mentor or friend. Claim reps are highly intelligent, analytical, and... View More
