Want to clarify in the beginning, I have a dash cam. I'm stopped on a two way street, about to make a left turn into a one way. There are two cars at a stop sign across me. I let the first car pass and start to make a left turn. The second car does not let me through and continues to follow... View More

The general rule is that a vehicle making a left turn has to yield to vehicles approaching from the opposite direction. In making their determination of liability, the insurance carriers will probably examine other factors as well, including the police report, testimony from other driver, your... View More
I am currently being sued for a minor car accident. Despite having ample car insurance, the lawyer for the other side is requesting information about umbrella/homeowner's insurance. They say it is required by law. I need to know if it is.

Under New York Civil Practice Law & Rules § 3101(f), you are required to disclose the existence of any insurance policy that might satisfy, in whole or in part, a judgment entered in the action. https://law.justia.com/codes/new-york/2010/cvp/article-31/3101/ Generally speaking, a... View More
Someone backed into 3 cars and mine was one of them. It got totaled. Insurance company is claiming they have to wait to sell one of the other cars involved in the accident before they can pay me out. I've been waiting long enough and I need the money now.

You should be able to sue, unless there are facts missing here. Whether you handle the matter yourself or you go through law firms, keep legal fees in mind. When it comes to handling property damage-only cases, law firms may not necessarily handle them on a contingency basis. Good luck

No police report was filed (error). Can't access video from the gas station apparently with out police approval, but no report. Insurance company says her word vs, his. Any recourse?

answered on Oct 5, 2021
If the matter involved low-level/low-speed property losses only, it could sometimes be difficult to arrange for an attorney to handle on a contingency basis. Depending on the type of policy, the carrier could pursue damages from the other side. Whether you act through the insurance carrier,... View More
Where do I have to turn? To the "two-way left turn lane" or normal lane? New York State

answered on Aug 7, 2021
Below, I've pasted a link to the NYS DMV page that outlines a number of different left turn scenarios. The resource covers left turns from one-way to one-way, one-way to two-way, two-way to two-way, two-way to one-way, and two-way to four-lane highway. I hope it helps. Good luck

The wording on the form says 10 days, without including any distinctions between weekdays, weekend days, holidays, etc. If you can get the form in within ten days, that would be best. Good luck

I was technically at fault due to being on a bike. Woman driving the car was messing with radio making a left hand turn. Insurance adjustor is pressuring me to settle tonight or I'll get nothing because tomorrow is 3 years.

I should have added, being on a bike does NOT “make you technically at fault”. A vehicle making a left turn is required to yield right of way to pedestrians and bicyclists. I have no idea how the accident happened, but that too is something to discuss with an attorney.
I wanted to know if i would go to jail if the crosswalk sign said to stop and i passed but the traffic light told the car to go almost hitting me. I dont know if this makes any sense...

answered on Jul 30, 2021
No one goes to jail for most traffic offenses (other than leaving the scene or reckless driving in some states).
If someone is in the crosswalk traffic has to stop. If no one is in it and traffic has a green light they may proceed.
I had went through one and they had me there like four hours. This was a car accident that wasn't my fault.

A deposition could last anywhere from less than an hour (not too common) to several hours. Four hours is not uncommon. I've had depositions that ran two hours and I've had depositions that have run over four hours as well. It all depends on the complexity of the case, contentiousness as... View More

Lawyer up quick! Your statute of limitations is only 1 year and 90 days, and you were supposed to file a notice of claim within 90 days of the incident. Your lawyer can make a motion to late-file the 90-day notice of claim, but if you blow the statute of limitation, your goose is cooked!

I'm sorry about your accident. I hope everyone is okay. If I understand correctly, you are New York City residents, but the accident occurred in Puerto Rico before your flight to New York. If that's the case, you should reach out to attorneys in Puerto Rico. If I did not understand... View More
I'm New York state and this is just a hypothetical: what happens if someone pulls up too close to me when I'm at a red light, and I roll back into them (I'm driving a manual car.)

This might be difficult with the passage of so much time. It could be easy if you could locate the attorney who represented you. But you might not be posting this if you had that information. If you can't do that, it could involve more work. Given the timeline you present, it looks like the... View More

I'm sorry about your accident. I hope all involved are okay. You may want to reach out to a criminal defense attorney to discuss confidentially in greater detail. Hi there – first, I’m terribly sorry about your matter. It sounds awful. It is difficult for any attorney to assess what the case is worth without knowing more information, such as the extent of your injuries. There are certain thresholds that need to be met in New York in order to bring a... View More

Car no. 2 should not be liable. However, in these multi-vehicle accidents, vehicles that are not at fault are sometimes dragged into the claim. Good luck

Depending on the facts it sounds like you could have a very strong case. You'll want to consult with an attorney as soon as possible to go over the facts.

Arguably they need to exercise reasonable care when towing your vehicle. That said, it's going to be a tough sell that the towing company was negligent in damaging your vehicle (which was illegally parked) because it did not use a flatbed truck as opposed to a standard tow truck.
Looking for advise if i have a case in small claim court NY
