I should have added, being on a bike does NOT “make you technically at fault”. A vehicle making a left turn is required to yield right of way to pedestrians and bicyclists. I have no idea how the accident happened, but that too is something to discuss with an attorney.
I wanted to know if i would go to jail if the crosswalk sign said to stop and i passed but the traffic light told the car to go almost hitting me. I dont know if this makes any sense...

No one goes to jail for most traffic offenses (other than leaving the scene or reckless driving in some states).
If someone is in the crosswalk traffic has to stop. If no one is in it and traffic has a green light they may proceed.
I had went through one and they had me there like four hours. This was a car accident that wasn't my fault.

A deposition could last anywhere from less than an hour (not too common) to several hours. Four hours is not uncommon. I've had depositions that ran two hours and I've had depositions that have run over four hours as well. It all depends on the complexity of the case, contentiousness as... View More
The accident occurred in october 2020, i submitted 2 auto body quotes, made a police report, and walked in person to assure that everything was done correctly, i received a letter the beginning of this year that they are still investigating even though there were 3-4 of us who hit that manhole in a... Lawyer up quick! Your statute of limitations is only 1 year and 90 days, and you were supposed to file a notice of claim within 90 days of the incident. Your lawyer can make a motion to late-file the 90-day notice of claim, but if you blow the statute of limitation, your goose is cooked!

I'm sorry about your accident. I hope everyone is okay. If I understand correctly, you are New York City residents, but the accident occurred in Puerto Rico before your flight to New York. If that's the case, you should reach out to attorneys in Puerto Rico. If I did not understand... View More
I'm New York state and this is just a hypothetical: what happens if someone pulls up too close to me when I'm at a red light, and I roll back into them (I'm driving a manual car.)
Currently I have STUDENT DRIVER and ROLLBACK WARNING, STAY BACK stickers on the vehicle.
I’m 46 now but was told when I was 10 yrs old this happened. I know the city and county but no record of anything in my name .

This might be difficult with the passage of so much time. It could be easy if you could locate the attorney who represented you. But you might not be posting this if you had that information. If you can't do that, it could involve more work. Given the timeline you present, it looks like the... View More

I'm sorry about your accident. I hope all involved are okay. You may want to reach out to a criminal defense attorney to discuss confidentially in greater detail. You could use the tab above (Find-a-Lawyer) or conduct searches on your own, or check with the Public Defender's Office (based... View More

Hi there – first, I’m terribly sorry about your matter. It sounds awful. It is difficult for any attorney to assess what the case is worth without knowing more information, such as the extent of your injuries. There are certain thresholds that need to be met in New York in order to bring a... View More

Car no. 2 should not be liable. However, in these multi-vehicle accidents, vehicles that are not at fault are sometimes dragged into the claim. Good luck

Depending on the facts it sounds like you could have a very strong case. You'll want to consult with an attorney as soon as possible to go over the facts.

He should speak with his car insurance company. However, I believe that he is liable from what you have said.

Arguably they need to exercise reasonable care when towing your vehicle. That said, it's going to be a tough sell that the towing company was negligent in damaging your vehicle (which was illegally parked) because it did not use a flatbed truck as opposed to a standard tow truck.

Instead of relying on a quick, general answer here, you may want to have someone knowledgeable in vehicle transfers look the documentation over. You're talking about payments, which could possibly mean lienholders/security interests on the vehicle, among other possible issues. Good luck... View More

If there are Medicare liens, those could take time to ascertain through NYC HRA. Some of the public agency-related liens could be handled by third-party contractors. The COVID situation has also resulted in delays. If your attorney is trying to negotiate the liens, that could take time too. But... View More

Car insurance is on the car, not the driver in New York. The insurance company may be saying that the car wasn't insured under them on the date of the accident. Make sure there wasn't another insurance company that covered the car at the time. You should sue the vehicle owner, the named... View More

In theory you can be sued. Anyone can sue anyone. If you are, send it to your insurance company. If you have no insurance, you will likely not be sued.

As a general rule, it is not permissible under ordinary circumstances.
