Given the excessive speed it would be in your best interest to consult with a lawyer. You do have the option to plead not guilty and your lawyer would then be able to advise you of your options from there.

Not really. If you were planning to try the case it might be part of a defense arguing the officer didn’t know what was going on, but it’s probably better to resolve with negotiation.

Q: I was recently given a ticket for reckless driving. I have no prior incidents on my driving and no criminal record

I live in ohio, am a navy vet, and have a lawyer who will represent me in court. He has said that I do not have to show up, and that we will plead not guilty. Is this a good move and should I show up? I also have not signed a contract with him. Should I get a contract?

MOST COURTS IN OHIO ACCEPT FAXED OR E-MAIL NOT GUILTY PLEAS FROM ATTORNEYS. IT AVOIDS WASTING THE ATTORNEYS TIME SHOWING UP AT AN ARRAIGNMENT WHERE NOTHING REALLY GETS DONE OTHER THAN A PLEA ENTERED AND A JUDGE ASSIGNED.

It likely means you didn’t pay the ticket on time and the court has issued a summons—a letter to you saying you have to come to court—and made a note that you technically have a warrant but that you’re being given the opportunity to simply come or pay and it will be recalled.

Plead not guilty and ask to talk to the prosecutor. You’ll get a pretrial date and you can explain what happened. Or you can have a lawyer do this for you. It’s not uncommon for such cases to result in a dismissal.

It’s kind of unclear where you are in the process. If you paid the ticket, it’s basically over. If you haven’t and can still go to court, you shouldn’t simply plead no contest, you should ask for a chance to speak with a prosecutor about reducing or dismissing the ticket.

What exactly is your question? He should have a lawyer represent him in the traffic ticket. There’s nothing you can do about the local news. Man wins Lamborghini for a day and does 130 down Market Street is exactly the sort of thing local news stations cover.

Q: My son was pulled over today for speeding. The county is Cuyahoga county. On Gates Mills road. He was going 68 in a 35.

He just turned 16 in May and has a clear record and no other traffic violations. Will this result in a suspended license? (weather was clear and perfect.) (no one else was on the road)

The mailing includes instructions for disputing the ticket. Unfortunately, it may not be worth it since those are usually a $100 fine and no points and you may be required to attend a hearing to dispute it.

Q: Can a cop give dus when no one was in the vehicle?

My truck was parked on side of the road helping with a broke down vehicle. I wasn't in it or seen driving it. Cop ran plates and saw suspended license. I was charged with driving under suspension. Will that stick in court? There was a licensed driver who could have been driving.

That’s not a great case for the state especially if there was a second driver on scene who could have been driving you truck. I wouldn’t be surprised if the officer’s version of events is different from yours.

You have a right to an attorney if you face a possible jail sanction. If it’s just a minor misdemeanor traffic ticket (punishable only by a fine), there is no right to counsel at public expense though you can still hire an attorney. Q: Officer gave me a breathalyzer test and two more 45 min later. Which bac is he allowed to use on ticket?

I blew .069 at the time of the stop. 45 min later at the station I blew two more times. The results then were .088 and then .09. Officer wrote .088 on ticket and my license was suspended under ALS

The test you take at the station is the admissible test. They typically write the lowest number from two or three tests at the station, which it appears the officer in this case did. You should hire an attorney.

Eventually, they’ll go to jail. The courts will work with people up to a point. Each judge’s breaking point is a bit different. But #4 without a license is over many of them.
