The power of attorney is meaningless now, it was only applicable during her lifetime. If you were the executor, you had the duty of following her will ( if any) and making funeral arrangements. Your claim is against your father. He authorized the work, so he should pay for it. He had apparently authority to act, so I don't think there is any fault on the part of the repair shop. It depends on the type of debt- but most contracts/accounts would be six years. The six years starts with a "default" or a missed payment. Making a payment extends the statute. You should consult an experienced lawyer to review the specifics of your situation.

If you can't pay your bill then the shop could seek a mechanic's lien. Not much to be done. Call legal aid if you feel like you're being charged unfairly. They may be able to assist.

Q: I was commissioned to do photos and now the client is refusing to pay. Can this be considered theft of services?

I have msgs confirming that they owe me money and also that they are refusing to pay me. Do I need to file in small claims court or can I just press charges through the police department for theft of services?

Usually filing a civil complaint for breach of contract is the proper remedy to your issue.

they are supposed to get it out promptly--within short time. If you were hurt contact a member of the Tenn Assn for Justice--they give free consults.

You can ask them to pay; if they refusce contact the consumer counsel for your state AG's office.
