The payments will be effected if he files a motion to modify based on his additional children. The visitation will not be effected by his lack of payments; however, he may loose rights through abandonment if he continues to lack contact.

If anyone were to face criminal charges (or contempt) in this situation it would most likely be your mom. If you come back to the States before your 18th birthday any adult you stay with could be charged with Harboring a Runaway Child.

Q: If a father is on supervised visitation, can the mother move to a different state w/o reporting to court

the youngest daughter (13) wants to move with her dad so the mom moved from Texas to Florida without telling anyone. How do the visitation work with this situation? And was the mother supposed to report that she was moving?

It depends on your current court order. Usually, most orders contain a geographical restriction which orders that the custodial parent cannot move the child away.

ICE doesn't always get involved in civil cases; however, sometimes they do. My best advice to you is to get a lawyer to help you with this and to try and work together with the children's mother as you definitely want to be supporting your children.

Q: Does the custodial parent who is receiving child support have any legal obligation to maintain gainful employment?

I live in Texas and the divorce was in Texas however my ex lives in Arkansas. She has never maintained a job over a few months at a time and has longer periods of non employment than employment.

No you can't force someone to have a job. It sounds like you may be mad that she is living off of your child support. Remember your support goes for things like your child's roof over their head, food, clothing, transportation, etc. It isn't meant to be an allowance that gets passed to them.

It depends. If the parent is married to the other parent then they are presumed to be the father of the child.

Call a lawyer and bond company for assistance. He still has a child support obligation for the child regardless if the mother of the child is deceased. Good luck.

The children's parent still has a responsibilty to support them. Remember they are not supporting you, they are supporting the children.

Q: Hello, I am currently pregnant but not married in the state of Texas.

I was told by a nurse that since we are not married it would be mandatory of him to pay child support if he signs that he is the father regardless if he is already helping or not since I am on Medicaid. Is this true? Or can you tell me more about this.

Any time there is a "substantial" change in circumstances child support can be changed. A move and change in jobs, etc. would qualify.

You can ask the court to extend it if they are disabled and meet the criteria specified in the Family Code. You will need the medical evidence to support it. You will need an attorney.
