Q: Can a person sue me for a completed job that my husband was paid in full for. He passed away on December 14,2020.

Now 5 months later she is suing me,his wife, for the money. The amount of$200.

If you have a paid receipt for the work that was performed, you have a defense of payment. It should be a straight forward defense.

Q: LANDLORD FILED AN EVICTION AFTER TENANT ASKED FOR COVID RENT RELIEF; RENT WAS STILL TIMELY. WHAT CAN I DO?

The likelihood to force anyone to do anything these days is slim to none. You may be able to file a formal complaint against the landlord with the Office of the Virginia Attorney General in Richmond, VA.

Q: What type of evidence or witnesses is a defendant limited to , if any ?

Example: defendant is charged with embezzlement by their employer. Defendant has been falsely accused amd is suspicious of being framed by employer . On March 29, 2021, the Centers for Disease Control (CDC) released an eviction moratorium order. It protects people from being evicted for not paying their rent if they complete a declaration form and give it to their landlord. This protection lasts until June 30, 2021.

You can speak with a law enforcement officer and a Magistrate Judge about filing a criminal charge. You more likely have a civil complaint and you should file a complaint with the Virginia DMV.

Q: Judgement in va ordered to pay . Hearing that defendant ordered to pay (was not notified of the hearing)

Why no record of service at clerks office . After receiving judgement order to pay attorney fees. Not only not notified of hearing but judge wrote no reason for judgement.

In Virginia, a judge will not enter a judgment against the defendant unless there is proof of service on the defendant. You may want to go to the Court to review the file or hire an attorney to review the file for you.

Q: I filed a civil suit against my ex and won. Am I allowed to charge him interest for being late, and if so how much?

he was already charged 6% interest for 16 days because he failed to take action and did not show up for court. If I can charge him where exactly is that listed I am keeping records of everything.

In Virginia, the legal rate of interest on a judgment is 6%. The court should award that interest on your judgment.

Q: At my last court hearing my arrears were 7177.00 and child support was paid up to current & case dismissed w/o prejudice

If we verbally agreed with witnesses no arrears were owed.. and 5 years later after I got custody back.. can she use dcse to try to obtain arrears.. when the case was never ever thru dcse??

Unless the documents are privileged such as an attorney work product privilege, the documents that are listed in the subpoena must be turned over to the attorney who subpoenaed them. You may want to hire an attorney for your side of the case.
