Q: Should a person plead no contest or guilty when leaving the scene of an accident in a parking lot, with no injuries?

Law enforcement was notified later that day. My son met with the owner the next day and insurance has covered the repairs. He was cited by the junior college police and is now facing misdemeanor charges. Should he get a lawyer?

A misdemeanor is nothing to be casual about. It is not an infraction, which is what most tickets are. Your son should definitely retain a criminal law attorney in Texas. Thank you for using Justia ask a lawyer.

If you went to the courthouse and paid the ticket, there is no reason anything would ever be sent to your house by the court. However, DOL will likely mail you a warning letter for having an infraction appear on your record.

Yes, the prosecutor can charge you with Reckless Driving even though you already paid an infraction fine for the same event. You can call the court clerk in Lincoln County and ask if a court appearance is required or can you just plead guilty and pay the fine.
