The 21 yrd. applied for adm. of estate and received a sum of life insurance money. She then kicked the sister out and is selling her father's things. Q: I have filed an uncontested divorce in Alabama, but didn't realize that the cat had to be included.

I have filed an uncontested divorce in Alabama. We agreed on everything, but we forgot to include the cat that was given to us by my Mom who has MS and couldn't care for the cat. I want the cat, but the soon to be ex wife has decided to keep the cat. What do I do?

You don't have an uncontested divorce. The cat is property and you didn't include it. You can go to court over the cat or agree

I assume this is an Alabama question. One or both of your parents would have to go to Court to attempt to modify custody. You don't get to decide.

Q: I want to file for an uncontested divorce from my husband because he's is addicted to drugs. What do I need to do?

We have been married since March 25, 2017 and we do not have any property together. He drives a car that is in my name. When we got married he moved into the apartment that I was living in with my daughters. The only property he has are his clothing and a motorcycle.

You must file the necessary pleadings in a Court of proper jurisdiction. If you don't know how to do that, you might consult an attorney

Yes, I'm in Alabama. So, would we have to have paternity tests done to get my name on both birth certificates first? I must say, there is a question about one of the kids if she's mine or not.

I assume this is an Alabama matter. Yes she can. She can ask for 2 years of back support if you are the father.

I assume this is an Alabama issue. THe police arrested you because they believed there was probable cause that you were the guilty party. Hire a criminal defense attorney and listen to what he or she tells you. DO NOT attempt to defend this yourself. GO see a lawyer.

You need to talk to a lawyer about this but, the land probably devolved to you and your brother. His part belongs to his estate now. You and his estate own the property together. Q: Can my sons father fill out a Birth Certificate/affidavit without my consent? Is hospital liable for this?

We were not married when my son was born. I was asleep and he filled out the B.C. and also the affidavit for paternity. I didn't give him the consent to do any of this as I wanted my sons last name as my last name.

He can execute an affidavit of paternity saying he is the father without your consent. You should talk to the hospital. The mother is the person who usually provides information like the name.

I am assuming this is an Alabama matter. If the husband is the father of the child, and has always accepted the child as his own and was married to the mother when the child was born, then he is the legal father. If he wants to , he can go into Court and deny paternity.
