I assume this is an Alabama question. One or both of your parents would have to go to Court to attempt to modify custody. You don't get to decide.
We have been married since March 25, 2017 and we do not have any property together. He drives a car that is in my name. When we got married he moved into the apartment that I was living in with my daughters. The only property he has are his clothing and a motorcycle.

I assume this is an Alabama issue. THe police arrested you because they believed there was probable cause that you were the guilty party. Hire a criminal defense attorney and listen to what he or she tells you. DO NOT attempt to defend this yourself. GO see a lawyer.

You need to talk to a lawyer about this but, the land probably devolved to you and your brother. His part belongs to his estate now. You and his estate own the property together. Divorce papers do not address anything past the age of 19.

He can execute an affidavit of paternity saying he is the father without your consent. You should talk to the hospital. The mother is the person who usually provides information like the name.

I am assuming this is an Alabama matter. If the husband is the father of the child, and has always accepted the child as his own and was married to the mother when the child was born, then he is the legal father. If he wants to , he can go into Court and deny paternity.
I have full custody, he has a unstable background. He has been working under the table (photo proof).
