I haven’t really seen my son in 4 months I’m so posed to see him 2 hours a week

Yes. You owe child support even if you don't see him. If she is keeping the child from you, address that with the Court.

The draft from the insurance company should come to both the owner of the property (you ) and the bank You are entitled under the divorce to the net amount. If she were to get the check and refuse to endorse it to you, you can always go to the COurt to make that happen. You might start by sending a... View More

I assume this is an Alabama divorce. All property that was acquired during the marriage or used for the common benefit of the parties during the marriage is divisible marital property and subject to division in a divorce.
We had a brief hearing after she tried to leave the state w/kids, and I filed a motion so the judge suspended the divorce and gave us time to reach an agreement, she has a lawyer now and filed for discovery and other motions, do I need her permission to dismiss if I want to save the marriage? Thanks

Did she file a counterclaim? If you are going to act as your own lawyer you ought to know what this is.

Not unless she has filed a counterclaim. I assume this is an Alabama matter.
Last night she called the police because I asked her to pay the bills on the 4th of next month, the police came and asked me to leave, I am a senior disabled handicapped male with 8 back surgeries and an Cardiac stent.
I see no reason for this type of treatment by the police, I had to leave... View More

I am an Alabama Lawyer. I don't handle Fla. divorces
The case was argued in court and agreement was hammered out in chambers. Original dispersal of assets was modified in court discussions and was presented orally to the court. The court reporter clearly stated the correct agreement and the lawyer that prepared the document clearly agreed to prepare... View More
My ex felt he didn't have to pay child support for my oldest as she has left for college. She's only 18, so I told him he still had to pay until 19. But I see it says if they are a college student, and not working, non-custodial parent still has an obligation to pay support. This is not... View More

Have you ever been to court? If you are the father and have custodial rights (visitation etc) with the child she has to communicate with you about this. 19 is the age of majority in Alabama. If you don't want to be 'erased' go to court.
The mother told me thru a text I'll never see my child again, so why am I still paying child support and I can't even see my child

I assume this is an alabama case. You have to go to court and establish visitation with your child. File a petition
My friend and her boyfriend have a baby together and everytime she tries to leave him he threatens to take the baby from her or call the cops on her for kidnapping. Can he do that?
answered on Aug 24, 2018
No. She cannot kidnap her own child. Second, he may be the presumptive father of the child, but there is no order of custody giving him any right to the child. See needs a lawyer.
How easy is it for the custodial parent to end the child support once the youngest reach 19?
answered on Aug 24, 2018
If there is more than one child on child support, and the oldest child turns 19, then you MUST go back to court to re-calculate child support. Unless your order sets out something different, you have to go to court and recalculate support. Be careful here. Sometimes the support for the remaining... View More

THe legal rights of the children are not self-executing. Take him to court. He is getting paid by some one. He is spending money from some where. Take him to COurt.
It's not far for my son

You can collect it like any other judgment. Does he have any money? Income? Assets? What?
We agreed originally to split everything down the middle but the judge rejected the papers. What is a good amount to put with us still agreeing to split everything down the middle so they will accept my divorce papers.

If you are trying to do this yourself, read and understand Rule 32 of the Alabama Rules of Judicial Administration. Calculate child support from that rule using the appropriate forms. If you don't do that, you will keep getting your documents back from the court.
He wants them every other weekend which is fine. He can be spiteful sometimes so I wanna make sure he can't keep them from me if I let them go with him. I do not wanna take them from him.

You wanna go get a lawyer. You must not make these arrangements outside of a court case.
