Yes. You owe child support even if you don't see him. If she is keeping the child from you, address that with the Court.

I assume this is an Alabama divorce. All property that was acquired during the marriage or used for the common benefit of the parties during the marriage is divisible marital property and subject to division in a divorce.

Q: Can you elaborate on counter claim We've filed motions ie discovery after we couldn't reach agreement does it affect it

We had a brief hearing after she tried to leave the state w/kids, and I filed a motion so the judge suspended the divorce and gave us time to reach an agreement, she has a lawyer now and filed for discovery and other motions, do I need her permission to dismiss if I want to save the marriage? Thanks

Have you ever been to court? If you are the father and have custodial rights (visitation etc) with the child she has to communicate with you about this. 19 is the age of majority in Alabama. If you don't want to be 'erased' go to court.

Q: Can a father take the child away from its mother if she tries to leave him?

My friend and her boyfriend have a baby together and everytime she tries to leave him he threatens to take the baby from her or call the cops on her for kidnapping. Can he do that?

No. She cannot kidnap her own child. Second, he may be the presumptive father of the child, but there is no order of custody giving him any right to the child. See needs a lawyer.

If there is more than one child on child support, and the oldest child turns 19, then you MUST go back to court to re-calculate child support. THe legal rights of the children are not self-executing. Take him to court. He is getting paid by some one. He is spending money from some where. Take him to COurt.

We agreed originally to split everything down the middle but the judge rejected the papers. What is a good amount to put with us still agreeing to split everything down the middle so they will accept my divorce papers.

If you are trying to do this yourself, read and understand Rule 32 of the Alabama Rules of Judicial Administration. Calculate child support from that rule using the appropriate forms. If you don't do that, you will keep getting your documents back from the court.

Q: What do I need to do to make sure my kids father can't keep them from me? I want us both to be in their lives.

He wants them every other weekend which is fine. He can be spiteful sometimes so I wanna make sure he can't keep them from me if I let them go with him. I do not wanna take them from him.
