There's not enough information here to answer your question adequately. This is because the federal and State court systems here in Illinois operate very differently. The federal courts in Illinois are divided into three separate federal districts, Northern, Central, and Southern. Each has... View More

He is facing criminal felony charges but they have in under the wrong date of birth he was wondering can he get the case dismissed

No. Separate and apart from the issue of a juvenile wrongly being charged as an adult because they used an incorrect date of birth making him or her older then he/she actually is, there is no way to dismiss a charge just because law enforcement lists one's date of birth incorrectly.... View More

I know you may not realize it, but you're asking for free work to be done.

Asking a lawyer what he or she thinks is asking the lawyer to provide work. Most of our work, before one of us may open our mouths in a courtroom, or in writing on an appeal..... is thinking through the problem...

I am assuming by your quesiton that this is a South Dakota State charge. Not a federal charge.

Yes. He will be very lucky if he doesn't get charged with a sex offense. But it can still happen.

He needs a lawyer immediately. He also needs to talk to no one about the case but his lawyer he hires.

Absolutely no one.

No. You may not contact the judge. It is extremely inappropriate.

If you're the one accused and you are asking to have someone's letter on your behalf not be considered by the judge, you're going to have to talk to your attorney about it. If you're representing...

Q: Will the judge change my charge from a misdemeanor to a felony for not accepting the plea deal?

I got a DUI a couple months back, and the judge gave me a plea deal which would make my charge a misdemeanor. Whenever I got the DUI, I didn’t have my license at the time. It sounds like you have a lawyer. You need to be asking your lawyer these questions and working with your lawyer.

Prosecutors have near absolute control over what the charge is. Not the judge. I have had many a client ask me to ask the judge to force the State to reduce a charge to a...

What you need to do is get a lawyer and stop talking about your case, including posts. Sometimes law enforcement can figure out who people are, and what you post can be used against you.

If the prosecutor can prove you helped the person commit the crime, you're guilty under the law....
