Q: Do I have to physically take my daughter back to her mother myself, or can I have my aunt take her.

My daughter is 9, her mother lives in kansas. Nothing in the divorce decree says anything about how she gets back as long as she gets back.

Read your order and see if it says a designated responsible adult can exchange.

Sounds like you don’t have any specifics in place upon your initial filing for divorce. In general both parents have rights to their children. Get temporary orders in place if you’re concerned.

Both parents have an obligation to take care of their children regardless if you two are in a relationship or not.

Q: He owns the home. It is a 5 bedroom home. I will leave, but I need my things and time to get my finances in order.

You can not force a parent to visit. You can file for child support and then that person is responsible whether he visits or not. The Attorney General assists with establishing child support orders. Connect with them.

The father can take his child to wherever he chooses on his own time unless your order dictates otherwise.

If there is no order in place then he should petition the court to establish his parental rights over his son.

Since before she can remember she has been in and out of homeless shelters, being evicted and staying in hotels, I believe it is in her best interest to be emancipated and stay with me until she is older because her Situation is very unstable and her father is very possessive

She would have to show that she can take care of herself in order to be emancipated. If she has to stay with someone else they it is probably going to be hard to prove this.

Contact a lawyer right away and provide them with all of the orders from the court. If you do not have them then they should obtain copies from the court. Your parental rights outweigh sister in law's rights. However, if you do not act right away then you are compromising your case. Good luck.
