Q: I was hit by a drunk driver but I did not have insurance, do I have any rights to sue the guy that hit me?

I have the police report and he was found to be at fault. He has no insurance and no license and was on probation for two prior dui convictions.

Yes you should contact an attorney to see if they can look for additional insurance, for example the owner of the car may be different, and yes I agree with all the other attorneys, small claims court an option, DA in the criminal case with victim restitution as well. Good Luck.

yes this is a problem now that CA has allowed $5000 in PD coverage for low income drivers. need to go through your son's insurance and pay deductible if that is an option, then you will get back a pro rata of deductible.

Yes it takes time when policy limits on multi car accident - need everyone approval plus subrogation if other people go through there own insurance then subrogate (that is what takes time), everyone treated equal with reductions proportional to all.

If the case has been filed and he noticed a deposition then yes. This is not a good idea to do the case / depo without an attorney if you have never done one before.

You can make a police report as a hit and run car accident with as much description as you can provide and then report it to your auto insurance company if you have UM coverage on your policy.
