My friends case is still open and he is very concerned and doesn't know what is going on. The stand in lawyer didn't inform him of his right to a speedy trial or anything and his lawyer is not doing anything about it.

often the best thing that a lawyer can do is "age" a case.
i assume it is a felony and not a misdemeanor?
he will get credit for the time he served in any sentence.
he can ask for the supervising public defender and complain about his lawyer's lack of attention.
I am not the victim. The state proceeded with charges after victim tried to retract. I am now married to him and they are denying my visits

He took off and by the time cops got there he was gone so far it's been 2 months and no words from the cops or anything how long does this take to go to court

That's a two part answer. You have two cases possible: family and criminal.
You control the family law case. You can file a domestic violence restraining order. You'll need to serve him, and then go to a hearing to make it effective. That lasts 1-5 years and can be renewed.... View More

this is a question you should present to your lawyer that is assisting you with the TRO????
you usually need more than documentation. You would need someone or some people to come to court to testify.

You have aright to notice of a hearing on a restraining order. If you don't want the restraining order, then contest it. By the way, doing this on your own is a bad idea. Get a lawyer. Good Luck
Restraining order was put in place during the time I was pregnant. Do I have full custody then?

Is it a criminal protective order (CPO) or a domestic violence restraining order (DVRO)?
Most likely not, the order would specifically list protected third parties, and if the child wasn't yet born, s/he probably isn't on the order. If a DVRO, you can go to court and ask for a... View More

Sort of. With the facts you describe, the criminal judge will likely grant the DA’s request for a CPO. You can reach out to your DA victim advocate to make sure they ask for this at the arraignment.
But there are advantages to also getting a DVRO. A CPO only lasts as long as there’s a... View More

If you or the minor child is a victim of domestic violence, you can file for a domestic violence restraining order and ask for temporary custody orders. At the permanent order hearing, the courts will often set another temporary order for custody pending mediation between the parties.
