Yes, however depending how long the case has been going on the court may not allow the attorney time to get ready so you would need to talk to the potential new attorney to have them evaluate if they could get more time and if they could be prepared if the judge denied a continuance.

the St/L for a misdemeanor is 1 yr. and a DV is a wobbler and can be filed as a misd or felony.
however, after that, i would guess there would be very little chance of a filing

1) Generally, any visible or identifiable injury such as a slash on the face is felony, not misdemeanor. 2) You cannot dismiss anything, only a district attorney can. 3) She needs good attorney ASAP. Have her call me or any local attorney who has experience in such cases.
