Since this is your first ticket for "failure to transfer title," it may not be necessary to hire an attorney. Many people handle these types of situations on their own, especially if the offense was unintentional and you’re already taking steps to correct it. You’ve already scheduled... View More

Q: Driving without motorcycle endorsement; obtained endorsement before court. Possible dismissal?

I was cited for driving without a motorcycle endorsement. I have my arraignment tomorrow but have since completed the basic rider course and obtained my motorcycle endorsement. There are no other offenses on my record related to driving without a license. Can I get the charge dismissed?

It’s great that you’ve already completed the basic rider course and obtained your motorcycle endorsement, as that shows you’re taking the situation seriously. Since your arraignment is coming up, the first step is to **inform the court** that you’ve now obtained the required endorsement. It... View More

Q: Am I at fault in a Florida car accident with improper lane change citation?

I recently got into a car accident while turning left into a plaza entryway in Florida. The entry has two lanes, one on the left and one on the right. Q: What are my chances with only a ticket as evidence?

I have a court appearance on Monday in Pasco County for a traffic ticket issued by FHP. The only evidence from the state is the ticket itself; there's no radar or dash cam footage. I was allegedly driving 55 in a 60 mph zone. The prosecution offered a deal of reckless driving without points,... View More

Presumably you have been ticketed for reckless driving. The ticket itself is not admissible evidence, testimony of the officer will make the case a matter of your word against that of the officer. So, it depends on whether the officer's testimony is believable beyond a reasonable doubt.

Normally FATE is a 3rd degree felony unless enhanced. If the police intended the vehicle in question to be used as evidence they would have seized it already. If it is your own property you can dispose of it in any manner. It may appear mitigating that you disposed of the instrumentality of the... View More

Generally, if you don't have bad traffic record, it is best to contest a ticket though you know you're guilty. That's because the Traffic Magistrate, at the initial hearing, may offer you a "deal" that is a better outcome than taking the ticket to trial. For example, the... View More
