It doesn't seem fair, but if an insurer-leaning therapist gave the FCE (or an insurer-leaning doctor who's reviewing the FCE and assigning the rating), he/she may very well assign a 0% rating, yes.

Q: If the PPD payments are straight math then why do we hear of insurance offering more to settle and close?

The insurance person offered $1000 extra payment to close the claim. This makes us think there is more than straight math in play. We also learned that mileage to medical can be included - the insco never told us this we had to find out on our own. What else are they not telling us?

You could try that. I would if it mattered. Whether those companies -- and more likely their insurance companies and risk managers who are driving this request -- would accept that is another matter. Q: Can the WC attorneys stop benefits if the case has an award and the claimant was determined to be permanently disabled?

My husband has been diagnosed permanently mentally and physically disabled. Now the wc attorney and insurers want to have him reevaluated by doctors hundreds of miles away. They have threatened to stop benefits if he doesn’t go to these appointments. This is a South Carolina case.

Yes - benefits can be suspended for all sorts of reasons that don’t make a lot of sense if you aren’t an expert in this area. WC won’t stop trying to save money on your husband’s case. Best to consult with an experienced lawyer so you can know what your rights and responsibilities actually are.

Q: Injured on job, workers Comp, unit closed, we were let go, should I have been fired?

Had surgery start PT tomorrow. I’m getting first WC check soon, been out of work since Dec. 2018. Got paid severance ended March 2019.

I have never been on WC before. Worked 31 years as a nurses aide.

Add up the weekly wage for the 13 full weeks worked before the injury and divide by 13. There are other methods for workers who were there fewer than 13 full weeks before the injury.

Short answer: it's more complicated than that. A lot of terms referring to employment status that are thrown around are sometimes used interchangeably or incorrectly. Yes you can. FMLA doesn’t pay benefits like workers comp, it just protects your jon for a limited time while you’re out. Don’t let the employer fool you into choosing one or the other. That’s not how it’s supposed to work.

You can only reopen an injury case if you immediately appeal the dismissal and can show clear error on the Court's part. "New evidence" doesn't allow the civil case to be reopened. But why not consult a member of the Ga Trial Lawyers Assn--they give free consults.
