Q: Failure to yield right of way while making a left turn to a car engaged in an unlawful maneuver. Is this negligence?

My husband was hit by a car passing to the right of cars stopped at an intersection on a one lane road as he was making a left turn. He was found to be partially negligent. Does the right of way rule apply to a car engaged in making an unlawful maneuver?

That's a bit complicated. More info into the specifics would be helpful and the best way to do that is a formal consultation with Durham County lawyer.

North Carolina is one of the few remaining states in the entire country that still has CONTRIBUTORY NEGLIGENCE. Indeed, there are...

Q: I wrecked my mom's car after swerving to miss a deer does her insurance have to pay me

I was driving my mother's car with permission. I am 45 years old. I swerved to miss a deer causing the car to flip. I hurt my back and have missed 4 weeks of work due to the accident. If you own a car and have insurance, that insurance is primary. That only covers your medical bills and lost wages (if wage loss was selected). You don't get to sue anyone because a deer caused it. Unless you can show the deer was a pet deer, and the owner didn't confine it, no person is... View More

GREAT QUESTION

Given your age, probably best to have your parent/guardian handle the issue.

A LOT depends on the damage(s), if any.

There are special considerations for provisional licensees. Your parent/guardian may wish to also speak with an attorney.

Q: why would a lawyer want 1,600 up front instead of taking it out of a settlement from an accident?

the lawyer filed a demand letter to the insurance company and now he is wanting to charge $1,600 just to sue the other party that caused the accident in the first place

Probably best to ask the lawyer. There are times when a pure contingency fee doesn't make sense.

One would have to think the lawyer gave the reasons / reasoning.

Talk to your lawyer.

Talking to a lawyer, at least to get general information about how to proceed, is a good idea. Many, if not most, "personal injury" lawyers in NC give a FREE CONSULTATION. I put "personal injury" in quotes because an important consideration is whether...

Your insurance covers the fire pretty much regardless of cause (i.e. won't cover it if caused by war, nuclear plant meltdown and other exceptions). Talk to your agent and don't get into who did what unless asked, Keep it simple. Car caught fire. Why I don't know. That's it.

You get points with a citation. You need to find out what the citation was for and when it was issued, for what court. Go to that court and see what was filed.. My experience is that sometimes people get citations when they have a license with an old address, citation goes to the old address, they... View More

Depends on whose fault the wreck was. If it was their fault they are, their Doctor may have some liability unless the vision was correctable. If doctor said get glasses, they don't --not the doctor's fault.
