Q: Who do I give the letter from the car insurance people saying costs have been covered to at court?

After I obtain a letter from my insurance saying the financial costs from a car accident have been covered, who do I give it to at court? And can I bring it to court before my court date?

Thanks!

You're talking about a court date, which suggests the other side has an attorney. Bring this court date to the attention of your insurance carrier. Reach out to your insurance carrier's claim rep and ask them to get in touch with the attorney for the people suing you. Insurance companies... View More

Q: An ATT tech hit my dog in front of our house, on a private driveway. They denied the claim because my dog was loose.

The dog wasn't on public road, but on the side of a private driveway, defecating. The driver was going too fast, was not paying attention, and hit and crushed her skull with his truck. My understanding is that my dog can be loose on private property. She did not run to, or in front of the... View More

File a claim with their insurance company. You can claim for the financial loss, and also may have a claim for negligent infliction of emotional distress. I'd suggest you talk to a member of the NC Trial Lawyers Assn/Assn for Justice --- they focus their practice on these types of cases, and... View More

Q: Do I have to wait for a passenger to finish treatment to settle with the insurance company?

I was in an accident (not at fault) and I am wanting to settle with the other person's insurance company. But i am under the impression that I can't do so until my passenger finishes treatment. Then and only then will the insurance company pay me.

No. But the decision will still be up to the liability examiner (together with carrier's counsel if your matter is in suit). If they have a bead on the injuries you and your passenger sustained in relationship to the limits of the policy and the reserves they set for the claim, they have... View More

Q: A dealer wiped the error codes from a car we were looking to buy, claiming it was perfectly functioning.

He also claimed it wasn’t in a collision . A pre purchase inspection found it was falling apart, many codes hidden, and there was evidence of it having been in a collision. Is this legal in NC?

No, it violates federal and likely state laws. If someone bought it they need to contact the consumer division of the AG's office.

Turn it over to your insurance. The problem you have is you are required to drive your car so that you can stop if the car in front jerks to a stop --for instance because a kid ran out in front. Trust me the company for the other driver will fight it. I've won a case like this but that was... View More

You'd likely get a warning (unless you are a jerk to the stopping officer). If ticketed it'd likely be for Improper Equipment - about a $263 ticket.

Assuming you reported this to the local police and your insurance company, if your collision insurance does not cover this incident for some reason, you can file a property damage claim. You would need to either repair the damage and have a paid bill or have an estimate of the cost of the repair.

Tell citi if they don't give the insurance for their car you will have to assume it's uninsured, and report them to the agency that regulates taxicabs. Follow up with action if they don't.

If you can prove your version of the events. You should be found not guilty. I get most charges of failure to report dismissed because the charging officer jumped the gun and charged within the 24 hour period. As to paying for the damages - the owner has a civil remedy for that.

Taking the big picture, lets say he just had to move it--same thing could've happened. It's not like he caused that--you'd have to be doing something unimaginable to stick a vehicle in park. Yes he shouldn't have moved it but it's the type of thing if he didn't you... View More
