Hello. The answer to that is "it depends." This is a question better suited for an attorney who practices in the county where the child lives. I will say terminating a parent's rights is the ultimate action a court can take concerning a child and they do not do it without very strong... View More

Hello. No. Child support must be addressed during the case. Best of luck!
Positive for marijuana, could I be allowed to be move out permanently considering I’m almost 18?

Yes in this situation DHR would probably allow you to remain in the home where you are, as long as they all test negative, as part of a safety plan
Force me back home? I’ve been living with these people since February.

Yes they can. Until you reach 18 you are considered the custody of your parents. If you refuse you can be charged as a juvenile and made to go home.
She works and the girls stay with their grandmother. Her husband got the girls for a 10 day visit and now refuses to let her come get them. His family keeps the girls while he works. Every member of his family has a history of drug abuse and felony theft. Is there any way she can get the children... View More

Maybe. Because they are married he has just as much right to keep the kids as she does. However if drugs are involved you could probably file and ex parte emergency custody alleging the chrildren are in some kind of danger and imminent harm. You can obtain an emergency custody Order that way. Call... View More

Termination of parental rights is different for each county. And your question is confusing. You said first he hasn’t seen the child in three years and further down in the paragraph you state the last contact was six months ago. That’s a big difference when trying to terminate. If he’s seen... View More
I’m trying to contact someone that could help me out with my child support case. This has been ongoing since 2010 with my ex mother in law xxx she was granted temporary custody of my children until I got on my feet, but the children were never in her care. They were with me and my ex husband from... View More

As long as there is an Order for support in place, you owe the money. You need to take her back to court to get it changed, however it will have to be done where the children reside. Wherever they are, file to domesticate the Alabama judgement and then petition to modify the child support. Sounds... View More
My daughter’s father and I have joint custody. He lives in another state. He has not contacted my daughter in 4 months. Before that it was 2 months. If he has gone for more than four months without providing any emotion, physical, financial or other support and has no contact with the child for that period you can file a petition to terminate his rights. You have the burden of proving that he has in fact abandoned the child within the meaning... View More

It would be difficult. You don't say how long ago you went to Court. You also don't say what you did to learn of his past. If you could have learned about this stuff (if only you'd looked) you can't go back to Court and say I didn't know. It is critical to know how long ago... View More

In a word, no. You have custody until she is 19 years old. If they keep the child from you they are committing custodial interference. Tell them send the child back to you.
He was ordered to pay child support back in October, but has only paid one month so far. He keeps giving the court the wrong names of his employers on purpose to avoid payroll withholding. You can go back to Court and ask for your support. If he is a danger to the child, you must show that to the Court.

At the time of their split if she has no job but can provide a place for them to live dan she get full custody?

Hello. They are not married so when mom moves out after the breakup, she needs child support either via private attorney action or her filing it via DHR. Custody only becomes an issue before the court if dad makes it one. Best of luck!

A petition to terminate your parental rights must be filed in the juvenile court. You would then file a consent. Be aware that such a termination does not make your back child support go away. Also, if the court believes that you just want to sign these rights away so you can avoid supporting the... View More

I'd have to know more facts to be able to express an opinion. However, you probably are ripe for a termination of parental rights petition. Call a lawyer in your area and do it now, before she re-establishes contact with the children.
