Call the consumer fraud unit of the New York County district attorney. To do this privately is a small claims case, which requires filing a complaint form but then returning for the trial. There is no way I could economically charge to handle this matter.

I live in New York. I was a defendant in a small claims case and I lost. I paid the plaintiff over two years ago. Your car was probably towed for tickets. It is rare for a credit card creditor to seize a car. They seize wages and bank accounts. For this amount, you would be better off settling it. Call the attorney who got the judgment. For $1200, the $800 I would charge to try to undo it is not worth the... View More
My landlord failed to serve proper notice of the renewal, and is now trying to raise rent at the last minute even though the contract has already renewed under the same terms. Depends on whether the notice was a requirement of the auto-renewal, but that said if a lease expires the general rule is that it becomes a month to month tenancy. The change in the amount of rent, if not part of the lease, would be an offer for a new lease and the existing lease would turn into... View More
Small claims court will only take cases in which both parties live or do business in that town. Can a tenant sue in small claims court a landlord living in NJ but owning a house in a town in NYS?
answered on Jun 20, 2017
I would check with the Town Justice Court, but my guess is that if you list the address of the house (owner) and the address in NJ, you will get the case started, and the Landlord will appear
answered on Jun 13, 2017
Sure you can. You will have to prove that your agreement was that he would reimburse you for his personal usage and then identify those charges which he incurred. I would suggest you go to small claims court if that option is available to you.

I had moved out of a house, and left a box of wedding sentimentals in the garage that the new rentee knew about. You may sue, but you will likely lose, unless you can prove that the sentimental value was known by the other side and she sold the handkerchief with the intent to cause undue harm. Otherwise, monetary damages will not attach to a sentimental value.

Unless you had an agreement that would support his position, it is likely this would be considered a "gift" rather than a loan. That being said, anything can happen in court, even small claims court, and you may want to consider reimbursing him for something as part of a settlement.

I paid $120 for an application fee, $800 deposit and May rent. After I signed my lease I was told there was a "Management fee" of $400 but there is no where in the lease about the fee. Do I have to pay?
answered on May 4, 2017
The only thing I can think of is that your lease may have referred to condo by-laws that you had a right to inspect and which could have alerted you to the fee. You can try to not pay, but they'll probably get you some other way. Best of luck!
