An Ohio attorney could advise best, but your question remains open for a week. It generally is. The fact that a car is parked illegally subjects it to parking violations, but doesn't give other motorists immunity from hitting it. In some instances, there could be additional factors, such as... It would depend on a few factors, a consultation with an attorney would be able to provide a more full answer than simply whether you were stopped with your foot on the brake is enough to not be at fault.
The driver at fault has no insurance and I didn’t have insurance for uninsured drivers

An Ohio attorney could answer best, but your post remains open for two weeks. Generally, insurance is designated for a particular car. Unfortunately, it doesn't ordinarily follow the driver. Good luck

An Ohio attorney could answer you best, but your question remains open for a week. As a general rule, insurance runs with the vehicle. Unfortunately, his insurance is likely to be limited to his vehicle. It could be worth looking into whether the incident qualifies under your policy's... View More

That’s not how insurance works. The injured party still sues you. You’re supposed to report the claim to your insurance and they then step in and take over the case. Not telling them about it is a reason to deny coverage. You need to contact your insurance and find out if you’re too late.
I came up over a hill to find an excavator crossing the road with only one warning sign a half mile back and no flaggers present I t-boned it going just under the speed limit I wasn’t suspected of or charged with an ovi or given a blood test or a sobriety test. The hospital did however do a... View More

Claims and lawsuits for personal injury require medical documentation, so your records would be admitted to show your condition after the accident. The at-fault party/company/insurance company may try to use evidence contained in those records to their advantage, if there is information that would... View More

An Ohio attorney could advise best, but you await a response for a week, and you may need to get moving in filing notices of claim with your insurance carrier if you are able to take that route. It does not look like you have a basis for an action against the City of Cleveland, unless it was a... View More

Since she had and didn’t use insurance, she has failed to mitigate her damages and could should have some trouble if you argue that in court. From a practical stand point, is $1500 a fair estimate of the damage? Can you afford it reasonably easily? Because it’s probably both the right thing to... View More

I hope your daughter is okay. An Alabama attorney and Ohio attorney should advise on this, but your post remains open for four weeks. As a general rule, carriers can apply the law of the state in which a matter occurred. But this could be more complex, because there could be choice-of-law issues... View More

The hospital most likely referred the matter to collection... View More

An Ohio attorney could advise best on this, but your post remains open for four weeks. At this point, you have probably discussed the matter with your insurance people and have learned about these routes. Some of the recourses you might have are to treat the property loss as a first-party claim if... View More

Talk to the local building dept. whether it is a violation. If not, and if landlord or company will not pay for repairs, you could sue in small claims court. The court will determine if they have any liability for failing to post a warning sign. But if the wire was in plain sight, the court... View More

I've seen insurance companies try to claim it was "arguable" or offer only 70 or 80 per cent liability. You could use your own collision if you have it and let them deal with it. If you were injured contact a member of the Ohio Assn for Justice--they give free consults.

If there was a tree down from someone's yard that fell in the street all the way across the road from ditch to ditch that caused us to have a bad accident. Can you go after the home owners insurance. There was no time to stop so we hit it at the rate of speed that the road allows.

The short Answer is maybe. It depends on why the tree fell and what their policy covers. It’s certainly worth looking into.
