If you were prosecuted it would most likely be in juvenile court unless there are special circumstances. Don't be afraid to get your parents involved.

No. Only the prosecutor can dismiss a criminal case. The alleged victim can let the prosecutor know that they HOPE the case will be dismissed and/or that they don't want to testify in court.... but the decision about whether or not to dismiss belongs to the prosecutor, not the alleged victim.
my brother been in since then but is eligible for parole but never makes parole. its been almost 25yrs.

What was his sentence? That is the maximum time he will serve in prison. Remember, parole is not a given at any time, so your brother must be prepared to serve his entire sentence.

Frankly, he could be charged with the murdering the Tooth Fairy. Any of us could. Ultimately, the question is whether the prosecution can prove their case beyond a reasonable doubt.

I started up an international chat room online, and I was wondering if I could face legal consequences for not reporting crimes that people claim to have committed, say that they are in the process of committing, or say that they are planning to commit. Does it depend on the crime?
answered on Sep 18, 2018
It depends on the situation; for instance if it is sexual assault of a child there is a duty to report it. The variables are too numerous to answer all but a good rule of thumb is to report instances when someone is in danger from future acts.
Parents have consented to being together. I just wanted to find out about the sexual part.

The felony crime of Sexual Performance By A Child applies anyone under 18 years old engaged in sexual conduct. The plain language of the law criminalizes the conduct itself, even if it does not occur as a performance. If there actually is a performance (or recording) then the parents themselves... View More

The most important thing to remember about a protective order is that its not YOUR order so you can't give him permission to violate the order. A protective order is a JUDGE'S order. Judge's don't tolerate their orders being violated, and they don't care about the excuse.... View More

My boyfriend and I got into an argument and he choked me, so I called the cops and he got arrested, then there was an EPO in place for 90 days, after it was off we started talking. He was put on probation. After a while he still keeps being abusive, so I planned to end things and request to put a... View More

It appears he may have violated the protective order so that is why he was arrested. The prosecutor should be willing to answer your questions. Call the County's victim advocate.

It is unlikely that anything will happen automatically without you hiring a local Family Law attorney to explore possibilities to further restrict or eliminate this person's access to his children.
I was told on a phone call by a park ranger that this is similar to a speeding ticket, that it would be a class c misdemeanor/infraction. I only have to pay $130 for the violation. He also mentioned that as long as I pay the fine it shouldn't go on my record.

This sounds like a scam.
Law enforcement officers typically don't call about class C misdemeanors.
Law enforcement officers typically don't ask for money, only the courts do that.
Paying a fine is the same as entering a plea of guilty or no contest, so it will... View More

answered on Jun 29, 2018
You may want to contact the District Attorney's office in your county and see if the State can obtain some type of protective order (which would be at no cost to you). If you desire you retain a private attorney, you will have to call around. There is no fee structure set by the State Bar,... View More
