I would recommend first that you attempt to meet with the Commonwealth's Attorney for the jurisdiction where this happened. Such a meeting would give you an opportunity to voice your concerns about the investigation and possibly get some answers from the lead prosecutor as to why no criminal... View More

It depends a lot on everything that happened between 2018 and 2021, and whether the type of cancer she got was likely very curable in 2018 and 2019.
As a cancer survivor myself, I know that we hate those six-month and annual CT scans. But they are very important and universally... View More

More facts are needed about the circumstances of the accident but, in general, the employer has immunity from liability for a work injury. Given the severity of his injuries, unless it can be proven by a medical expert that the death resulted from negligent treatment and he otherwise would have... View More

If you have an attorney already, it would be best to schedule an appointment to discuss your concerns in person with them.
If you do not have one yet, I would recommend retaining someone experienced with personal injury.

Sorry to hear about your trouble with gummies. Your question is difficult to answer without additional information. First, were you injured as a result of the metal? Did you break a tooth, cut your mouth? If you did not injure yourself, you probably don't have any damages, and without... View More

I'm very sorry for your loss. A local state attorney could answer best, but your question remains open for two weeks. There is no universal answer. It could depend on the nature of the case (respective liabilities of the parties involved), the damages being claimed, the willingness of both... View More

It's hard to say on this fact pattern alone. There are certainly fact patterns that can result in both a charge and a conviction if it arises to that level. But it's certainly possible to get charged. Getting charged means there is probable cause which is not a high standard. Getting... View More

Sounds like a violation of law. Contact a member of the Va. Trial Lawyers Assn as there may be a claim for "misuse of a corpse."
Details about the case won't be released to me, because it has to do with the murderer and not the victim. Can I take this to court and have all evidence and case info released to me? Also would I be able to sue the state for wrongful death?

I'm very sorry for your loss. You need to consult with an experienced personal injury lawyer, if you are seeking to find alternative theories of liability.
The driver at fault also died and was in a company owned vehicle. Should I wait till their insurance offers a settlement before hiring an attorney. I'm my aunt's beneficiary. She had no children and was widowed

Wrongful death cases can be quite complicated. An estate will need to be set up. You should at least schedule a free consultation with a local personal injury attorney to discuss the law and the applicable legal rights. You should at least talk to the attorney about the proposed division, get something in writing, if you aren't sure then go to the hearing. He was your dad and it may bring you a bit of closure. End of the estate!

It would be a difficult case--much would depend on what you signed. However I would check with a member of the Va. Trial Lawyers Assn--they give free consults. You have a brutal situation, and I apologize for having to treat this in a cut and dried manner. First, it may possibly be a police matter. If you know the insurer you would want to advise them that there is a question as to the beneficiary's right to claim.

In order to sue for wrongful death, there basically must be someone with a lot of money to go after. Otherwise, there is no sense in getting a judgment against someone who is indigent.
