Q: Hi I got $350 worth school zone tickets rushing to work during the pandemic because I work in a hospital.

I wrote the traffic department explaining the reason for my speed but they didn't throw out the tickets. Can I sue for the unnecessary stress it brought me?

You can't sue for the stress. There is no legal theory on which to base such a cause of action. If you believe it won't adversely impact your job, you could politely ask if reimbursement from the hospital is possible. The answer is likely to be no at most workplaces, but these are unusual... The District Court schedules all trial dates based on officer and court availability. Courts were closed by emergency order of the Court of Appeals for several months during the COVID-19 pandemic, and all trials canceled and rescheduled to dates after the court is reopened. Phase 1 of the... View More

There is a website for the San Mateo courthouse online. You should search for that and find out how they are handling traffic or any kind of case. You may be a lucky one that is caught with the COVID Court closures, and not be assessed for FAILING TO APPEAR, which adds at least and additional... View More

The ticket that you signed, giving your promise to appear, in order to be released will have a date on it by which you need to report to Court. You don't have to go at that exact date as long as you go BEFORE that date to see a Judge for Arraignment- entering a plea. Having said that, the... View More

First, the collection agency is collecting a debt. They are not the Department of Motor Vehicles (DMV) and have no power to suspend your driving privilege. Second, you mentioned "grace" period. Did your insurance company deny coverage for this accident even though you just bought the car?... View More

Q: The police officer put Covid 19 as my name on my speeding ticket. Am I still liable? And why would he do that?

Assume the officer was preoccupied and made a clerical error. Whether the State will pursue prosecution depends on if enough information was gathered to generate a complaint (an error on the ticket itself is not sufficient to cause dismissal). Calling an attorney may help. Good luck.

It seems they did not get notice that you completed your Traffic Safety School. Most Counties, are terminating Court Supervision satisfactorily, if all conditions of the sentence have been met and they have proof in the court file. If there is now proof, they are extending the termination dates due... View More

Q: What are the chances I would win if I take it to court, (especially given the covid-19 situation).

Cop was driving in the opposite direction and made a U-turn. By the time he flashed his lights, the speed limit had changed from 35 to 45 after a right turn. He claimed I was going 50 in a 35 (before the right turn), but I'm sure I wasn't going more than 45. He did end up giving me a... View More

The CFR would keep it off of your record. That seems like a reasonable disposition. There is no guarantee that taking the matter to court will get you a better result. The COVID-19 issues will not have any effect whatsoever on things. Court dates are simply being delayed because of the... View More

You can call your county district court and they can look it up for you. Courts aren't shut down, but many have limited hours. If you were stopped in a city by a city police officer, you might want to try the municipal court.

Make sure you act quickly, after 15 days the court can...
