Q: I told my grandmother to call the police for me because my gf wouldnt leave so i left instead, probable cause for arrest

i refused to identify myself being that i didnt do anything wrong but was thrown to the ground an searched without notice

You have already asked the same question and I have already responded to that same question. You must identify yourself if asked by a Police Officer. If you fail to do so or give a false name, you will be charged with Obstruction at the very least.

Q: if my description is given to the police without having committed a crime do i have to talk/identify myself to police?

If a Police Officer asks you what your name is, you have to tell them your actual name. If you give them a false name or refuse to tell them your name, you could be charged with Obstruction, which is a Misdemeanor offense.

Q: Can you change venues weeks before trail about to start from state to state?

Illinois state citizen charged with felony crime in South Dakota wants to change venues to Illinois the state they reside in. Can this happen also will the charges be the same? How will the case be handled?

No, this is not a civil case. Criminal cases are heard in the State and County where the offense occurred. No, tickets can be amended up to the time of trial. Request Court Supervision if possible.

Q: i got pulled over today and the officer took my license and said that he would bring my license to my house.

I am just wondering if i got a ticket or not. he didnt say and told me to drive away without my license. did i get a ticket?

Hard to say. The Officer could always mail you a ticket but it is weird that the Officer would bring your license back to your house. I am sure there is some misunderstanding on your part.

Q: Was pulled over and given a court date for not having an up to date insurance but it was up to date?

Could only find the expired insurance card when the police officer first approached. Then pulled up the current one on the mobile app and showed him once he returned from his vehicle. Officer said “I don’t have time for this” and gave me the court date information. Is this legal?

Yes. Such show up to court with the current proof of insurance showing that you were covered on the date and time the ticket was issued and the ticket will be dismissed. If you do not wish to appear in court, you could hire an attorney to appear in court on your behalf.

This is not a simple speeding ticket. This is a criminal offense and you really should hire an attorney to assist you with this matter. Most of the time, an attorney will be able to get the ticket amended to a petty offense but that attorney needs time to work your case, so hire an attorney now.

Yes you still have to take the class in order to get Court Supervision on your first ticket. You need to court to court on your second ticket and request Court Supervision. You are allowed two Court Supervisions every 12 months. Court Supervision is not a conviction and will not cause you any... View More

The offense will be reported to Texas and most states do not recognize Court Supervision from Illinois.

Q: Do I have to pay court fines before a "hold" is lifted off my license? So I can apply for one in a new state?

You could try to have your case motioned up into court to see if the fine could be reduced, but you would have to appear in court in order to have this done and you should hire an attorney to assist you. Other then that, you need to pay the fine to have the hold removed.

You really should motion up your DUI matter into court to see if your Supervision can be reinstated. It is not likely, but it does not hurt to try.
