It is common practice by the Cook County Circuit Court Clerk to send any license in a file back to the Illinois Secretary of State Office. Q: Why is an accident showing up on my driving record? I was issued a ticket, but it was thrown out in court.

CITATION ISS FOR TRAFFIC VIOLS OTHER THAN SECTIONS 11-501 OR 11-502 OF THE IVC

PERSONAL INJURY ACCIDENT

Can I somehow get this removed? Again, the citation was thrown out in court.

Not sure what type of background check you are referring to, but Petty Traffic Offense typically do not show up on background checks. This will require further review by an attorney. The sooner you contact an attorney, the better.

Q: I feel I was not at fault when I received a failure to reduce speed ticket. What should I do?

I was driving down and alley and the person I hit was backing out of their driveway. They didn't look or slow down. I tried to swerve to avoid hitting them but we still collided.

81 in a 55 is 26 mph over the posted speed limit which is a criminal offense in Illinois. Yes, the speeding ticket can be issued after the fact. If the ticket is marked "No Court Appearance Required", you could just pay it but if it is marked "Court Appearance Required", she will have to appear in court.
