Q: 2 speeding tickets within 10 months. Will going to court results a license suspension and for how long?

My daughter is 19 yrs old She got first speeding ticket 09/2018 & paid fine. Second speeding ticket 7/31/2019. Officer told her she was going 10 over but put down 15 over. Also told her that if she does not want conviction, go to court. ??

It takes 2 convictions within 24 months to cause a license suspension because she is under 21 years of age. The ticket that was paid in 2018 will count as a conviction. She needs to avoid a conviction on the new ticket to avoid a license suspension. She should appear in court. If she received... View More

Q: How long do points assigned to a driver's license last? (Moving violation for cell phone use in Illinois)

I was given two tickets for using my cell phone as a GPS, one incident was August of 2016 and the other was April of 2017.

For purposes of a license suspension they are only used for 1 year if you are over 21. If under 21, 2 years.

Some do, some don't. Depends what type of offense, what agency issued the ticket and how it was charged by that agency. Generally, if the ticket is payable to the courthouse, it will likely be reported to SOS.

Unfortunately, the accident can still be loaded on your driving record regardless of the sentence you received on the ticket. It does not count against your driving privileges as a moving violation, but, of course, can be seen by your insurance company.

Because he is under 21 years old, 2 convictions within 24 months will suspend his license. Court supervision does not count as a conviction. A fine would likely be assessed if she simply pleads guilty. However, if you can obtain registration prior to court, bring it with you and the ticket may be dismissed.

Supervision is not on your public record, which is what insurance uses. It takes 3 conviction when you are 21 or older to cause a license suspension (2 within 24 months if under 21).

Because you are over 21, it would now take 3 convictions within 12 months to cause a license suspension. Of course, it’s best to try to avoid a conviction regardless. Unfortunately, you or an attorney will likely need to appear in show the proof of insurance and resolve both tickets. That would be required in the vast majority of courthouses. You can contact the Clerk’s Office at the courthouse where your case is assigned to confirm.

If you show proof of insurance acquired after the ticket was issued, you should be granted court supervision, which would prevent the suspension of your driver's license as long as you obtain SR22 insurance. The Judge should give you time to pay fines.

My colleagues are correct. You cannot receive court supervision, which means an automatic conviction unless the charge is amended.
