Can I make a claim against the hospital?
answered on Oct 27, 2016
I wouldn't put these facts without more information into the category of a medical negligence case; at least not a case that my firm would take on for a couple of reasons. One, importantly it does not seem clear yet how your son's condition will end. Just because the bone had to be... View More
It has been months - can I do anything to speed it up?
answered on Oct 27, 2016
Assuming you are awaiting payment from your insurer, I would write a letter, certified mail, to the insurance carrier, copy your insurance agent and then notify by copy of that letter demanding payment to the Illinois Department of Insurance. That should get the insurer's attention and get... View More
My mother died from a pulmonary embolism on 08/31/2016 while taking Xarelto. Her death comes 5 months after being in the ICU in March of 2016, and, after her Wafarin was replaced with Xarelto in the fall of 2015. When she was released from the hospital she was put back on Xarelto, and now, 5 months... View More

From your description it sounds like the facts may lead an attorney to research whether the prescribing of Xarelto was contraindicated for your parent and thus would fall into a medical malpractice/wrongful death matter. If you haven't already, i would consult an attorney who specializes in... View More
but the contractor didn't finish the job so we'd like to counter-sue - do we do that the same day as the court date that's been set?
answered on Oct 27, 2016
If the case filed against your parent is pending and no answer is due or has been filed yet, assuming the complaint is not fundamentally defective as a matter of law, your parent can file an answer and counterclaim together if within the time. If your parent is late with an answer or other... View More
I am starting a business in which I am taking online reservations from foreign students for a private school based in the US. The school is willing to pay me a commission for each student I bring. I am thinking of charging students the full tuition cost, then I would take care of their enrollment... View More
answered on Oct 21, 2016
From the facts you presented, if you were to contract with the students and they were to pay your company or you directly you could have liability exposure should some contract issue arise where the school or you/your company were viewed to be in some sort of breach of that contract. Whenever an... View More
Would I be able to bring suit for them? They have no family as far as I can tell.

You should report the neglect of another resident to the administrator of the nursing home or care facility. You should also alert the Illinois Department of Health and Human Services who will likely investigate your complaint. As far as you being able to bring an action for this person, you... View More

There are no federal taxes associated with a personal injury settlement or recovery. As long as the terms of the settlement reached are for the personal injuries without any part of it designated as a recovery of wages or benefits, there is no federal taxes due on the settlement.
I feel like it's the facility's job to make sure he is kept safe - can we sue them?
answered on Oct 15, 2016
There are cases that would support a claim against the nursing home for injuries a resident suffers from an incident like the one you described with another resident. The facts surrounding the incident are very important. Who was the attacker? Does that attacking resident have a history of... View More
Does his employer take care of everything or does he?

Assuming your husband was driving the company car that it owns, the company would provide liability and casualty insurance coverage and protection to your husband if he were responsible for damage to another vehicle or injury to another person. So my short answer based on your question is yes, the... View More
which are not going to change the outcome of the progression of her disease - it feels like these guys are just doing this to rack up a higher bill. Is there anything I can do?
answered on Oct 7, 2016
You should definitely bring this to the attention of your mother's treating physician and to the nursing home administrator. If your inquiries are not answered I would suggest you contact the Illinois Department of Health and Human Services which inspects Illinois nursing home and handles... View More
They admitted that they left the bolt lose. They gave me a free oil change for their mistake This could have been a deadly mistake. A free oil change is a slap in the face. Are they anything else that I can do? Thanks Shawn

Fortunately nothing much more injurious occurred. If the dealer corrected the problem at no cost, you wouldn't have any damages in which to make a claim.
The taxi accelerated suddenly while customer was getting in cab and unintentionally injured the customer's hand. The taxi driver thought an oncoming vehicle was going to run into him so he panicked and accelerated from the curb

If the driver's negligence was a cause of your injuries, then you may be successfully bring a lawsuit or claim for the damages suffered.
Am I still able to recover from his estate?
answered on Oct 2, 2016
The short answer is yes. I would be asking whether or not this person had insurance that covered this incident. A lawyer will be able to explain to you the need to spread the record of the person's death assuming the case is in suit.
The sign does not say for existing customers. Or anything else. Just free Money orders. And if I were getting a money order wouldn't that make me a customer? It's not until you ask for a money order that they tell you there is a charge Or fee.

This sounds like textbook bait and switch. You may want to inform the company of that impression and inform the local better business bureau and attorney general's office of this apparent false advertisement.
- he seems pretty out of it. If I can prove that's the case, can I sue them?
answered on Oct 2, 2016
In any case of negligence or abuse, the element of damages must also be present. For now I would encourage you to advise the nursing home director that your dad is being over medicated or at least seems to be. Find out what doses of medication are being given and why. Your father's doctor... View More
Wasn't I suppose to be informed? Can I sue for neglence if they felt like they did all they could do for my mother? I ordered a complete record of her file and the DNR paper is not there or my power of attorney papers not there neither. Do I have a case?
answered on Oct 2, 2016
Whether you have a case or not depends on whether the failure to provide resuscitation efforts at the end would have made any difference if you had interceded with the POA. It is not possible to provide a definitive answer to your question without knowing about all of the medical/hospital issues... View More

I would recommend that you reach out to a lawyer who handles "lemon law" cases for starters. There may also be lawyers handling the breach of warranty class action against Nissan for some of the same issues.

You should have a local lawyer review your contract with the pest control company. You may have a cause of action for breach of contract if the company did not provide you with the promised result.
He does not have his license yet. Are we able to get any money from the other person involved even if my son was not supposed to be driving?
answered on Sep 23, 2016
I am assuming your son was injured in this crash and that another driver was at fault. If that is true, I believe that you for your son if he is a minor may make a claim for his injuries.

I suggest you contact the Illinois Department of Health and Human Services about this. It will investigate and file a report of its findings. Depending on what the cause of death was, you may want to consider whether to have an attorney review the hospital and nursing home records to see if there... View More
